Inside Westchester County

What the data looks like here.

Westchester County runs on rail lines and old parkway suburbs, and our pre-probate and inheritance data here averages 170 new records a month, 160 in a typical one. The file comes from death and property records, so it does not wait on a Surrogate's Court filing.

Why investors work Westchester County

New York assesses property at market value and has no acquisition value system, so a death here does not reset the tax the way a sale does in states that cap assessments. What does move is STAR, which is registered to the owner rather than the parcel: the Tax Department expects the new owner to register, and until an heir qualifies alone the school tax bill can land higher than the decedent's. There is no inheritance tax, and the state estate tax credit disappears once the taxable estate exceeds 105 percent of the basic exclusion amount under Tax Law 952. Real Property Law 424, in effect since July 19, 2024, also lets an owner record a transfer on death deed, signed before two witnesses and notarized, so a house can pass outside an ordinary probate case.

On the ground

The county's own planning history draws the first useful line at Interstate 287, which bisects Westchester: the interior grows hillier north of it, and the density sits south along Long Island Sound and the lower Hudson. Development followed the Bronx River Parkway, completed in 1925 as the first modern limited access road in North America, with new houses built on former estates and farms once commuters could reach them. The same document notes the Hudson shoreline shifting from industrial use to mixed residential and commercial projects in Yonkers, Hastings-on-Hudson and Peekskill. An investor comparing a Yonkers two-family with acreage in North Salem is looking across three or four housing eras, not one market.

Where probate is filed

In the Ninth Judicial District, the Surrogate's Court of Westchester County has taken probate, administration and accounting filings through NYSCEF since May 3, 2017; small estate and guardianship matters are e-filed only by consent. The court's own page points researchers to WebSurrogate, the Unified Court System's free estate search, which returns filed names and shows document images for matters filed on or after February 19, 2014. New York sets no waiting period before a probate or administration petition may be filed, though SCPA 1802 protects a fiduciary for seven months from the issuance of letters, the practical floor for distribution. A filed estate is a public record, so any competing investor can pull the same names from the same portal. Article 13 voluntary administration reaches personal property of $50,000 or less and, under SCPA 1302, cannot carry a house. USLeadList instead works from death and property records about five weeks after a death, often before a filing exists and whether or not one ever does, and caps the county at three subscribers.

Why pre-probate

Why pre-probate leads in Westchester County, New York?

Probate-only data misses half the opportunity. Many estates never enter probate at all — joint tenancies, trusts, surviving spouses. Pre-probate covers them.

01

Motivated heirs, fresh inventory

Owners of Westchester County properties going through probate are typically highly motivated to sell — overwhelmed by upkeep, distance, or emotion.

02

First contact wins

Probate court is slow. Planting the seed early — well before the courthouse data publishes — is what closes deals six months later.

03

"As-is" pricing

Pre-probate properties typically sell as-is. The path to a below-market acquisition is substantially shorter than retail listings.

04

Full property + heir data

Size, location, value, tax info, and (with skip tracing) heir phone and email. Built to be worked, not just mailed.

What we mean by pre-probate

Pre-probate > probate. Here's why.

Our Westchester County data contains probate leads but isn't limited to them. The best opportunities are estates that never enter probate at all.

Most New York couples own under "Joint Tenancy."

When one spouse dies, the surviving spouse immediately inherits — no probate. Pure probate lead sources miss every one of these.

The surviving spouse often wants to sell, quickly:

  • Overwhelmed by upkeep without their spouse
  • Emotional weight of staying in the family home
  • Moving in with other family

FAQ

Westchester County-specific questions.
How many Westchester County pre-probate records arrive each month?
About 160 in a typical month, 170 averaged over the last twelve, with 55 months of tracked history. The slowest month dropped to 98 and the peak reached 222.
Does NYSCEF cover every Westchester Surrogate's Court filing?
No. Probate, administration and accounting matters have been mandatory NYSCEF cases since May 3, 2017. Small estate and guardianship filings enter electronically only by consent, under the state's consensual e-filing rule.
Can a New York transfer on death deed skip Surrogate's Court?
It can, if the deed was signed before two witnesses who were present at the same time, notarized, and recorded in the county clerk's office before the owner died under Real Property Law 424. Article 13 voluntary administration reaches only personal property, so it cannot move a house.
