Probate rules matter because they determine when a public court record appears and which inherited properties never appear in an ordinary probate case.

What changes for an heir

Michigan does not pressure heirs to sell. It collects no inheritance tax for deaths after September 30, 1993. Proposal A uncaps taxable value to state equalized value the year after a transfer of ownership (MCL 211.27a(3)), but MCL 211.27a(7)(u) and (7)(v) exempt residential real property conveyed, including from a trust, to the decedent's or the spouse's mother, father, brother, sister, son, daughter, adopted son or daughter, grandson or granddaughter, provided it is not used for any commercial purpose after the conveyance, so a child inheriting the family home does not uncap. Cost appears only if the heir rents it out, forfeiting that exemption, or does not occupy it, which requires rescinding the principal residence exemption within 90 days (MCL 211.7cc) and restores up to 18 mills of school operating tax (MCL 380.1211). Probate is easy to avoid here.

Ways property can avoid ordinary probate

Lady Bird deed, the enhanced life estate deed, which is standard Michigan practice and moves real property at death with no probate filing, together with revocable living trusts, joint ownership, and for small estates the affidavit of decedent's successor or the petition and order for assignment.

Small-estate route

$53,000 for decedents dying in 2026 and $51,000 for 2025, from a $50,000 base set by 2024 PA 1 effective February 21, 2024 and adjusted annually under MCL 700.1210. Two routes: the Affidavit of Decedent's Successor, available 28 days after death and limited to estates that include no real property (MCL 700.3983); and the Petition and Order for Assignment, which may include real property, from which indebtedness secured by that real property is deducted up to $264,000 in 2026, and under which heirs remain answerable for the decedent's unsatisfied debts for 63 days after the order (MCL 700.3982).

Timing investors should understand

On appointment the personal representative publishes notice to creditors, and a claim not presented within four months after the date of publication is forever barred; a known or reasonably ascertainable creditor discovered later must be notified within 28 days of the representative first learning of them (MCL 700.3801). The small estate affidavit requires 28 days after death (MCL 700.3983) and the order for assignment carries a 63 day period of successor liability (MCL 700.3982). No Michigan judiciary source publishes a typical duration.
