Verified state rules behind the county data.Probate rules matter because they determine when a public court record appears and which inherited properties never appear in an ordinary probate case.
What changes for an heir
New Mexico resets a house's taxable value when an heir takes it. NMSA 7-36-21.2(A) caps annual growth in residential valuation at 103 percent of the prior year, but paragraph (A)(3)(a) removes the cap and subsection (B) requires current and correct market value in the tax year after a change of ownership. Subsection (E) carries eight exceptions. A transfer to a spouse is excluded, and so is a transfer to a child occupying the property as a principal residence, though that child is deemed to take a change of ownership in the first tax year in which the child no longer qualifies for the head of household exemption on it ((E)(4)). A home the parent held in a revocable trust also keeps the cap when it passes to that trust's beneficiaries, occupied or not ((E)(7) and (E)(8)). Where the house passes by deed or through probate to an heir who does not live in it, the cap goes and the property is revalued, then taxed on 33 1/3 percent of market value (NMSA 7-37-3), so a home held for decades under the cap can jump sharply in the heir's first year. New Mexico has no inheritance tax, and its estate tax equals a federal credit that federal law reduced to zero (NMSA 7-7-2, 7-7-3).
Where probate records appear
Probate Court for informal and uncontested matters; District Court for formal and contested proceedings New Mexico Case Lookup is free and requires no registration, but it covers only the appellate, district, magistrate, metropolitan and municipal courts and returns case information rather than documents. County probate court cases are not in it. re:SearchNM, which replaced Secured Odyssey Public Access on April 7, 2023, adds documents for the Odyssey courts including probate case types in the district courts, but requires registration and assigns access by user tier. A county probate court record must be obtained from that county's probate court.
Ways property can avoid ordinary probate
Transfer on death deed under the Uniform Real Property Transfer on Death Act, NMSA 45-6-401 and following, enacted by Laws 2013 ch. 38 effective January 1, 2014; joint tenancy with right of survivorship; revocable living trust; and for a surviving spouse the homestead affidavit in NMSA 45-3-1205.
Small-estate route
Affidavit of successor in interest under NMSA 45-3-1201, available 30 days after death when the value of the entire estate wherever located, less liens and encumbrances, does not exceed $50,000 and no personal representative has been appointed anywhere. The $50,000 figure has applied since a 2011 amendment effective January 1, 2012, raising it from $30,000. The affidavit may not be used to perfect title to real estate. Separately, NMSA 45-3-1205 lets a surviving spouse take the couple's homestead by an affidavit recorded with the county clerk six months after death, where no probate is pending, the homestead was held as community property or was devised to the spouse, and its full value as assessed for property taxation does not exceed $500,000, a ceiling set in 2011.
Timing investors should understand
A probate may be filed no earlier than five days and no later than three years after death (NMSA 45-3-108; New Mexico judiciary probate guide). The creditor floor is NMSA 45-3-801: the personal representative may publish notice once a week for three successive weeks, after which creditors have four months from first publication, or four months from the published notice and 60 days from a mailed notice, whichever is later. NMSA 45-3-803 bars pre-death claims at the earlier of one year after death or those notice periods. The binding floor on closing is NMSA 45-3-1003: a personal representative may not file a closing statement earlier than six months after original appointment, a period raised from three months effective July 1, 2016. New Mexico publishes no official typical duration.
