Inside Bernalillo County
What the data looks like here.We cover Bernalillo County with pre-probate and inheritance data: roughly 194 new records a month across Albuquerque, and 196 on average over the trailing year. The file is built from death and property records without waiting for a probate filing.
Why investors work Bernalillo County
New Mexico caps how fast a home's taxable value can climb, but inheritance usually ends that protection. Under NMSA 7-36-21.2, a change of ownership removes the annual limit and requires current and correct market value the next tax year; the exceptions are narrow, covering a transfer to a spouse or to a child who lives there as a principal residence. A ranch house that sat under the cap for decades can be valued far higher in an heir's first year, which turns keeping, renting or selling into a real arithmetic problem. Bernalillo County holds a lot of exactly that housing, the postwar ranch and Spanish-Pueblo stock that fills the Northeast Heights.
On the ground
Albuquerque's East Mesa was cheap land developers avoided for years because the sand hills flooded and eroded in the rainy season. The subdivisions that covered it hopscotched outward, and the Albuquerque Historical Society's account of the Vista Larga district shows how fine the lines inside one plat can be: east of Princeton Avenue the developer set modest Spanish-Pueblo houses, while west of Princeton he laid out larger lots for custom Mid-Century Modern homes. An investor new to Bernalillo should read the plat and the lot size before trusting a ZIP code, because older subdivisions near the university mix modestly priced and architect-designed housing on the same few blocks.
Comparing Probate Lead Sources in Bernalillo County
Bernalillo County elects its own probate judge, and its Court of Wills, Estates and Probate takes informal, uncontested matters on paper, outside the state's electronic filing system, while formal or contested cases go to the Second Judicial District Court and Odyssey File and Serve. New Mexico lets a probate be filed as early as five days after death and as late as three years. A filed Bernalillo probate case is a public record: the court's own docket lookup reaches back to 1964, and any competing investor can pull the same case by name or number, while the statewide New Mexico Case Lookup leaves probate court cases out entirely. A recorded transfer on death deed is a separate route that can move a house with no ordinary probate case, so a docket search will not surface every inherited property. USLeadList builds its file from death and property records instead, typically about five weeks after the death, without waiting on a filing and without being limited to estates that reach court. No more than three subscribers get each county file.
How New Mexico rules shape Bernalillo leads
Verified state research, applied locally.New Mexico resets a house's taxable value when an heir takes it. NMSA 7-36-21.2(A) caps annual growth in residential valuation at 103 percent of the prior year, but paragraph (A)(3)(a) removes the cap and subsection (B) requires current and correct market value in the tax year after a change of ownership. Subsection (E) carries eight exceptions. A transfer to a spouse is excluded, and so is a transfer to a child occupying the property as a principal residence, though that child is deemed to take a change of ownership in the first tax year in which the child no longer qualifies for the head of household exemption on it ((E)(4)). A home the parent held in a revocable trust also keeps the cap when it passes to that trust's beneficiaries, occupied or not ((E)(7) and (E)(8)). Where the house passes by deed or through probate to an heir who does not live in it, the cap goes and the property is revalued, then taxed on 33 1/3 percent of market value (NMSA 7-37-3), so a home held for decades under the cap can jump sharply in the heir's first year. New Mexico has no inheritance tax, and its estate tax equals a federal credit that federal law reduced to zero (NMSA 7-7-2, 7-7-3).
Ways property can avoid probate
Transfer on death deed under the Uniform Real Property Transfer on Death Act, NMSA 45-6-401 and following, enacted by Laws 2013 ch. 38 effective January 1, 2014; joint tenancy with right of survivorship; revocable living trust; and for a surviving spouse the homestead affidavit in NMSA 45-3-1205.
Small-estate route
Affidavit of successor in interest under NMSA 45-3-1201, available 30 days after death when the value of the entire estate wherever located, less liens and encumbrances, does not exceed $50,000 and no personal representative has been appointed anywhere. The $50,000 figure has applied since a 2011 amendment effective January 1, 2012, raising it from $30,000. The affidavit may not be used to perfect title to real estate. Separately, NMSA 45-3-1205 lets a surviving spouse take the couple's homestead by an affidavit recorded with the county clerk six months after death, where no probate is pending, the homestead was held as community property or was devised to the spouse, and its full value as assessed for property taxation does not exceed $500,000, a ceiling set in 2011.
Timing that affects the public record
A probate may be filed no earlier than five days and no later than three years after death (NMSA 45-3-108; New Mexico judiciary probate guide). The creditor floor is NMSA 45-3-801: the personal representative may publish notice once a week for three successive weeks, after which creditors have four months from first publication, or four months from the published notice and 60 days from a mailed notice, whichever is later. NMSA 45-3-803 bars pre-death claims at the earlier of one year after death or those notice periods. The binding floor on closing is NMSA 45-3-1003: a personal representative may not file a closing statement earlier than six months after original appointment, a period raised from three months effective July 1, 2016. New Mexico publishes no official typical duration.
Where court cases can be checked
New Mexico Case Lookup is free and requires no registration, but it covers only the appellate, district, magistrate, metropolitan and municipal courts and returns case information rather than documents. County probate court cases are not in it. re:SearchNM, which replaced Secured Odyssey Public Access on April 7, 2023, adds documents for the Odyssey courts including probate case types in the district courts, but requires registration and assigns access by user tier. A county probate court record must be obtained from that county's probate court.
Why pre-probate
Why pre-probate leads in Bernalillo County, New Mexico?A public probate list requires a filed case. Our source does not require a filing and may precede a later filing, but that is not guaranteed.
Inheritance creates a property decision
A death does not guarantee a sale. It does create practical decisions about upkeep, distance, taxes, repairs and whether anyone in the family wants the property.
Earlier than a court filing
When probate is required, the public case begins after the death and after someone files. Our county records begin with the death record itself.
Not limited to probate cases
Trusts, survivorship ownership and state-specific transfer instruments can move a property without an ordinary probate case. Court-only lists do not identify those paths.
Property data with optional contact enrichment
Size, location, value, and tax information come with the property record. Phone, email, spouse, and relative data are available through the skip tracing add-on.
What we mean by pre-probate
Pre-probate > probate. Here's why.Our Bernalillo County data is not a court probate list. It identifies inherited-property records from deaths, including properties that may later enter probate and properties that never do.
The court docket is only one transfer path.
A trust, survivorship ownership or an authorized transfer deed may keep a property out of an ordinary probate case. The exact rules vary by state, which is why the local court and transfer details above matter.
An inheritance creates choices, not a guaranteed sale:
- Keep or occupy the property
- Rent it or transfer it within the family
- Sell it privately or through a public listing
