Inside Macomb County
What the data looks like here.Macomb County produces about 267 new pre-probate and inheritance data records in a typical month, 293 on average across the last twelve, and no more than three investors ever see the same one. It is built from death and property records, not from a probate filing in Mount Clemens.
Why investors work Macomb County
Michigan does not push heirs to sell: there is no inheritance tax on a death after September 30, 1993, so the decision an heir faces is what the house costs to keep. Proposal A normally uncaps taxable value to state equalized value the year after a transfer, but MCL 211.27a exempts a home passed to a child or grandchild, so a son or daughter who keeps the family house usually keeps its capped value. The cost appears only if the heir rents it out, uses it commercially, or stops occupying it and lets the principal residence exemption lapse; MCL 211.7cc allows 90 days to rescind it, and up to 18 mills of school operating tax can return. Macomb's own housing assessment counts nearly half the county's homes as more than 45 years old, which is the age band where a tax reset changes what keeping the house actually costs.
On the ground
Macomb splits into three planning bands, and the county's own housing assessment maps them. The South (Warren, Eastpointe, Roseville, St. Clair Shores, Fraser) is the most urbanized, with the oldest housing stock and densities over 6,000 people per square mile in Center Line and Eastpointe. The Central Region (Sterling Heights, Clinton Township, Shelby, Macomb Township) holds most of the county's homes and the bulk of its townhomes and multifamily, while the rural North carries the highest share of mobile homes. Pricing all three bands off one comp set is the classic out-of-town mistake. Mount Clemens was world famous for its mineral baths in the late 1800s.
Comparing Probate Lead Sources in Macomb County
Decedents' estates in Macomb are heard by the Macomb County Probate Court in Mount Clemens, a three-judge bench. Filings run through MiFILE, deployed court by court, and a filed case becomes a public record any investor can pull through the judiciary's MiCOURT Case Search. Michigan's small-estate routes cut two ways: the Affidavit of Decedent's Successor, usable 28 days after death under MCL 700.3983, is a non-court route that reaches no real property, while the Petition and Order for Assignment under MCL 700.3982 can include a house but is filed with the court. The recorded Lady Bird deed is the opposite: an enhanced life estate deed that passes real property at death with no ordinary probate filing. Where a personal representative is appointed, creditors get published notice and a claim not presented within four months is barred under MCL 700.3801, so the docket starts late. USLeadList closes that gap: the Macomb file is built from death and property records about five weeks after a death, often before a later filing and regardless of whether one opens, sold to at most three subscribers.
How Michigan rules shape Macomb leads
Verified state research, applied locally.Michigan does not pressure heirs to sell. It collects no inheritance tax for deaths after September 30, 1993. Proposal A uncaps taxable value to state equalized value the year after a transfer of ownership (MCL 211.27a(3)), but MCL 211.27a(7)(u) and (7)(v) exempt residential real property conveyed, including from a trust, to the decedent's or the spouse's mother, father, brother, sister, son, daughter, adopted son or daughter, grandson or granddaughter, provided it is not used for any commercial purpose after the conveyance, so a child inheriting the family home does not uncap. Cost appears only if the heir rents it out, forfeiting that exemption, or does not occupy it, which requires rescinding the principal residence exemption within 90 days (MCL 211.7cc) and restores up to 18 mills of school operating tax (MCL 380.1211). Probate is easy to avoid here.
Ways property can avoid probate
Lady Bird deed, the enhanced life estate deed, which is standard Michigan practice and moves real property at death with no probate filing, together with revocable living trusts, joint ownership, and for small estates the affidavit of decedent's successor or the petition and order for assignment.
Small-estate route
$53,000 for decedents dying in 2026 and $51,000 for 2025, from a $50,000 base set by 2024 PA 1 effective February 21, 2024 and adjusted annually under MCL 700.1210. Two routes: the Affidavit of Decedent's Successor, available 28 days after death and limited to estates that include no real property (MCL 700.3983); and the Petition and Order for Assignment, which may include real property, from which indebtedness secured by that real property is deducted up to $264,000 in 2026, and under which heirs remain answerable for the decedent's unsatisfied debts for 63 days after the order (MCL 700.3982).
Timing that affects the public record
On appointment the personal representative publishes notice to creditors, and a claim not presented within four months after the date of publication is forever barred; a known or reasonably ascertainable creditor discovered later must be notified within 28 days of the representative first learning of them (MCL 700.3801). The small estate affidavit requires 28 days after death (MCL 700.3983) and the order for assignment carries a 63 day period of successor liability (MCL 700.3982). No Michigan judiciary source publishes a typical duration.

Why pre-probate
Why pre-probate leads in Macomb County, Michigan?A public probate list requires a filed case. Our source does not require a filing and may precede a later filing, but that is not guaranteed.
Inheritance creates a property decision
A death does not guarantee a sale. It does create practical decisions about upkeep, distance, taxes, repairs and whether anyone in the family wants the property.
Earlier than a court filing
When probate is required, the public case begins after the death and after someone files. Our county records begin with the death record itself.
Not limited to probate cases
Trusts, survivorship ownership and state-specific transfer instruments can move a property without an ordinary probate case. Court-only lists do not identify those paths.
Property data with optional contact enrichment
Size, location, value, and tax information come with the property record. Phone, email, spouse, and relative data are available through the skip tracing add-on.
What we mean by pre-probate
Pre-probate > probate. Here's why.Our Macomb County data is not a court probate list. It identifies inherited-property records from deaths, including properties that may later enter probate and properties that never do.
The court docket is only one transfer path.
A trust, survivorship ownership or an authorized transfer deed may keep a property out of an ordinary probate case. The exact rules vary by state, which is why the local court and transfer details above matter.
An inheritance creates choices, not a guaranteed sale:
- Keep or occupy the property
- Rent it or transfer it within the family
- Sell it privately or through a public listing
