Inside Hays County
What the data looks like here.Hays County sits between Austin and San Antonio on the I-35 corridor, and USLeadList's pre-probate and inheritance data adds 52 new records a month, 52 on average across the last twelve. It is built from death and property records without waiting on a probate filing.
Why investors work Hays County
Texas has no estate tax, so what an heir faces in Hays County is not a bill at death but the cost of holding the house afterward. A non-occupying heir loses the residence homestead exemptions and the 10 percent appraisal cap once the owner's qualifying exemption lapses, while an heir who moves in can claim the homestead exemption without clear title. The Texas Historical Commission's survey of rural Hays County documents the change underneath: the county's once-prosperous eastern farming section now struggles to make agriculture pay. A death does not force a sale, and many heirs keep the house, but it does force a decision about exemptions, carrying cost, and whether a transfer on death deed recorded before death takes the property out of court altogether.
On the ground
In Hays County the dividing line is the Balcones Escarpment, not the city limits. The Texas Historical Commission's survey of rural Hays County describes a narrow eastern strip of Blackland Prairie suited to crops and a larger western half on the Edwards Plateau, once the county's poorest ground because little would grow there. That western land became Wimberley and Dripping Springs, prized for creeks and views and now being carved into ranchettes and suburban tracts, while Kyle and Buda on the prairie side turned into the growth corridor. Treat a house west of the escarpment and one east of it as different assets, not one county market.
Comparing Probate Lead Sources in Hays County
Hays County has no statutory probate court, so estate applications are filed with the County Clerk and heard in the Hays County Courts at Law, which share original probate jurisdiction with the constitutional County Court. Attorneys e-file through eFileTexas, and the County Clerk's Public Access portal returns Civil, Family and Probate records by name or cause number, so a filed estate is a public record any competing investor can pull. Texas does offer a 30-day small estate affidavit when an intestate estate's non-homestead assets stay under $75,000, but it is filed with the court and cannot pass real property outside the recorded homestead exception. A transfer on death deed, recorded in the Hays County deed records before the owner dies, is the route that genuinely moves a house with no ordinary probate case. USLeadList starts from death and property records rather than a court file, typically about five weeks after a death, often ahead of a later filing and independent of whether one is ever opened, and each lead is sold to no more than three subscribers.
How Texas rules shape Hays leads
Verified state research, applied locally.Texas has no estate tax and no inheritance tax, the inheritance tax having been repealed effective September 1, 2015. The 10 percent appraisal cap expires on January 1 of the first tax year in which neither the owner when the limitation took effect nor that owner's spouse or surviving spouse qualifies for a Section 11.13 exemption (Tax Code 23.23(c)), and the exemptions lost are substantial, including $140,000 of appraised value exempt from school district tax under Tax Code 11.13(b). The school tax ceiling an owner aged 65 or older held under Tax Code 11.26 passes only to a surviving spouse aged 55 or older who keeps the home, never to a child. An heir property owner who occupies the house is considered the sole recipient of any exemption granted for that residence homestead (Tax Code 11.13(h)) and the sole owner for qualification (Tax Code 11.41(c)), and can apply without clear title, on a death certificate and a utility bill, because the application form may not require an heir property owner to produce a recorded instrument (Tax Code 11.43(o) and (o-1)). The squeeze lands on non occupying heirs, who lose the exemptions and the cap and pay on a full market appraisal.
Ways property can avoid probate
Transfer on death deed under Estates Code Chapter 114, in force since September 1, 2015 and effective only if recorded in the county deed records before the transferor's death. Also the Lady Bird or enhanced life estate deed, probate of a will as a muniment of title under Estates Code 257.001 where the estate owes no unpaid debt other than a lien on real estate, and the Estates Code 205.001 small estate affidavit.
Small-estate route
Small estate affidavit under Estates Code 205.001, available only where the decedent died intestate, 30 days have elapsed since death, no petition to appoint a personal representative is pending or has been granted, and estate assets excluding homestead and exempt property do not exceed $75,000, a figure set by 2017 House Bill 2271 effective September 1, 2017. Estates Code 205.008(b) keeps the affidavit from transferring real property, with one exception: under 205.006 it may pass title to the homestead where the homestead is the only real property in the estate and the affidavit is recorded in the deed records.
Timing that affects the public record
Statutory floor: within one month after receiving letters the personal representative must publish notice to creditors in a newspaper of general circulation in the county where the letters were issued (Estates Code 308.051), and within two months must give notice to each known secured creditor (308.053). Texas imposes no general creditor claim period; a 121 day bar applies only to an unsecured creditor the representative chooses to notify under 308.054, so an independent administration is not held open by a statewide claim window. A will may not be admitted to probate after the fourth anniversary of the testator's death unless the applicant shows they were not in default (256.003). The small estate affidavit is usable 30 days after death (205.001). No Texas judiciary source publishes a typical duration.
Where court cases can be checked
No free statewide trial court search. re:SearchTX is the statewide index of e-filed trial court records and sits behind a sign in. The Case Search at search.txcourts.gov is the appellate TAMES system covering the Supreme Court, the Court of Criminal Appeals and the courts of appeals, and it holds no trial court cases. Failing those, the county clerk's own online records.
Why pre-probate
Why pre-probate leads in Hays County, Texas?A public probate list requires a filed case. Our source does not require a filing and may precede a later filing, but that is not guaranteed.
Inheritance creates a property decision
A death does not guarantee a sale. It does create practical decisions about upkeep, distance, taxes, repairs and whether anyone in the family wants the property.
Earlier than a court filing
When probate is required, the public case begins after the death and after someone files. Our county records begin with the death record itself.
Not limited to probate cases
Trusts, survivorship ownership and state-specific transfer instruments can move a property without an ordinary probate case. Court-only lists do not identify those paths.
Property data with optional contact enrichment
Size, location, value, and tax information come with the property record. Phone, email, spouse, and relative data are available through the skip tracing add-on.
What we mean by pre-probate
Pre-probate > probate. Here's why.Our Hays County data is not a court probate list. It identifies inherited-property records from deaths, including properties that may later enter probate and properties that never do.
The court docket is only one transfer path.
A trust, survivorship ownership or an authorized transfer deed may keep a property out of an ordinary probate case. The exact rules vary by state, which is why the local court and transfer details above matter.
An inheritance creates choices, not a guaranteed sale:
- Keep or occupy the property
- Rent it or transfer it within the family
- Sell it privately or through a public listing
