Inside Brazoria County

What the data looks like here.

Each Brazoria County lead goes to no more than three subscribers, and we cover the county with pre-probate and inheritance data. A typical month brings 109 new records, built from death and property records, so it does not wait on a probate filing in Angleton.

Why investors work Brazoria County

Brazoria County holds two housing eras in one line: the Brazosport towns Dow Chemical built after it arrived at Freeport in 1939, Lake Jackson included, and the Pearland and Alvin edge that filled in as Houston pushed south. Those eras produced different houses, and Texas adds a cost decision on top of that. A non-occupying heir loses the residence homestead exemption and the 10 percent appraisal cap under Tax Code 23.23, while an heir who actually occupies the house can claim the homestead as an heir property owner under Tax Code 11.13(h). The over-65 school tax ceiling passes only to a surviving spouse 55 or older, never to a child. So keep, rent or sell is a real calculation here, not a formality.

On the ground

The Brazos River is the county's oldest dividing line, and the county's own history traces the split: the northern end grew as Houston spread south, while the southern and central towns grew around the plants. Austin's first colonists landed at the river's mouth in 1821, and the earliest towns, Velasco, East Columbia, Columbia and Brazoria, all sat on the water; the seat only moved inland to Angleton in 1896. Lake Jackson is the southern city worth knowing: Alden B. Dow planned it in 1941, curved the streets, called the through roads drives and the roads into the center ways, and had crews spare the live oaks. Check which side of the river a parcel falls on before comparing two addresses.

Comparing Probate Lead Sources in Brazoria County

Probate in Brazoria County is heard by four courts, County Courts at Law No. 1 through No. 4, each also styled a Probate Court of Brazoria County, and local procedures alternate new probate filings so each gets an equal share. Applications go through the County Clerk, attorneys file in eFileTexas, and filed cases land in the clerk's public case search. A small estate affidavit under Estates Code 205.001 waits 30 days, is filed with the court, and under 205.008(b) cannot transfer real property except a recorded homestead. The genuinely non-court route is a transfer on death deed under Estates Code Chapter 114, recorded in the county deed records before the owner dies. That matters because the docket is useful but late and shared: a case appears only after someone files, and the same names sit in a public portal any competitor can pull. USLeadList identifies inherited Brazoria properties from death and property records instead, typically about five weeks after a death, often before a later filing and independent of whether one is opened.

How Texas rules shape Brazoria leads

Verified state research, applied locally.

Texas has no estate tax and no inheritance tax, the inheritance tax having been repealed effective September 1, 2015. The 10 percent appraisal cap expires on January 1 of the first tax year in which neither the owner when the limitation took effect nor that owner's spouse or surviving spouse qualifies for a Section 11.13 exemption (Tax Code 23.23(c)), and the exemptions lost are substantial, including $140,000 of appraised value exempt from school district tax under Tax Code 11.13(b). The school tax ceiling an owner aged 65 or older held under Tax Code 11.26 passes only to a surviving spouse aged 55 or older who keeps the home, never to a child. An heir property owner who occupies the house is considered the sole recipient of any exemption granted for that residence homestead (Tax Code 11.13(h)) and the sole owner for qualification (Tax Code 11.41(c)), and can apply without clear title, on a death certificate and a utility bill, because the application form may not require an heir property owner to produce a recorded instrument (Tax Code 11.43(o) and (o-1)). The squeeze lands on non occupying heirs, who lose the exemptions and the cap and pay on a full market appraisal.

01

Ways property can avoid probate

Transfer on death deed under Estates Code Chapter 114, in force since September 1, 2015 and effective only if recorded in the county deed records before the transferor's death. Also the Lady Bird or enhanced life estate deed, probate of a will as a muniment of title under Estates Code 257.001 where the estate owes no unpaid debt other than a lien on real estate, and the Estates Code 205.001 small estate affidavit.

02

Small-estate route

Small estate affidavit under Estates Code 205.001, available only where the decedent died intestate, 30 days have elapsed since death, no petition to appoint a personal representative is pending or has been granted, and estate assets excluding homestead and exempt property do not exceed $75,000, a figure set by 2017 House Bill 2271 effective September 1, 2017. Estates Code 205.008(b) keeps the affidavit from transferring real property, with one exception: under 205.006 it may pass title to the homestead where the homestead is the only real property in the estate and the affidavit is recorded in the deed records.

03

Timing that affects the public record

Statutory floor: within one month after receiving letters the personal representative must publish notice to creditors in a newspaper of general circulation in the county where the letters were issued (Estates Code 308.051), and within two months must give notice to each known secured creditor (308.053). Texas imposes no general creditor claim period; a 121 day bar applies only to an unsecured creditor the representative chooses to notify under 308.054, so an independent administration is not held open by a statewide claim window. A will may not be admitted to probate after the fourth anniversary of the testator's death unless the applicant shows they were not in default (256.003). The small estate affidavit is usable 30 days after death (205.001). No Texas judiciary source publishes a typical duration.

04

Where court cases can be checked

No free statewide trial court search. re:SearchTX is the statewide index of e-filed trial court records and sits behind a sign in. The Case Search at search.txcourts.gov is the appellate TAMES system covering the Supreme Court, the Court of Criminal Appeals and the courts of appeals, and it holds no trial court cases. Failing those, the county clerk's own online records.

A court-file list covers only estates that reach a public probate case. USLeadList starts with death and property matching instead of waiting for that filing.

Why pre-probate

Why pre-probate leads in Brazoria County, Texas?

A public probate list requires a filed case. Our source does not require a filing and may precede a later filing, but that is not guaranteed.

01

Inheritance creates a property decision

A death does not guarantee a sale. It does create practical decisions about upkeep, distance, taxes, repairs and whether anyone in the family wants the property.

02

Earlier than a court filing

When probate is required, the public case begins after the death and after someone files. Our county records begin with the death record itself.

03

Not limited to probate cases

Trusts, survivorship ownership and state-specific transfer instruments can move a property without an ordinary probate case. Court-only lists do not identify those paths.

04

Property data with optional contact enrichment

Size, location, value, and tax information come with the property record. Phone, email, spouse, and relative data are available through the skip tracing add-on.

What we mean by pre-probate

Pre-probate > probate. Here's why.

Our Brazoria County data is not a court probate list. It identifies inherited-property records from deaths, including properties that may later enter probate and properties that never do.

The court docket is only one transfer path.

A trust, survivorship ownership or an authorized transfer deed may keep a property out of an ordinary probate case. The exact rules vary by state, which is why the local court and transfer details above matter.

An inheritance creates choices, not a guaranteed sale:

  • Keep or occupy the property
  • Rent it or transfer it within the family
  • Sell it privately or through a public listing
