Galveston County probate court records: how to search them
What is public, where to search, and what it misses.Galveston County has a statutory probate court, the Probate Court of Galveston County in Galveston, which hears probate and guardianship applications, petitions and motions as well as mental health commitments; the County Clerk files and dockets its cases.
How to search the record
The County Clerk's court information page links its court records search, an online portal whose Smart Search looks up court records and whose Search Hearings finds hearing dates. When an application to probate a will is e-filed, the original will must be filed with the clerk within three business days. Texas generally bars admitting a will to probate after the fourth anniversary of the death (Estates Code 256.003).
What the court record misses
The portal shows the same Galveston County estates to every investor who searches it, and only after someone files. Homes held in living trusts never reach the court. Probate lists leave out trust-held homes. Ours include them. USLeadList is a data company and is not affiliated with the court or the County Clerk.
Inside Galveston County
What the data looks like here.Over the last 12 months, Galveston County's pre-probate and inheritance data averaged about 104 new records a month, and the busiest month since March 2022 reached 124. The file is built from death and property records without waiting on a probate filing.
Why investors work Galveston County
Texas homestead rules put most of the carrying cost of an inherited house on the heir who does not move in. The $140,000 school tax exemption follows the owner and can pass to a surviving spouse who stays, so a child living elsewhere inherits at full market appraisal without it. That makes the heir's real question one about the cost of keeping the house, whether or not anyone files a case. The county's housing came in waves: wartime shipyard work at Pelican Spit pushed the population up almost 40 percent in a single decade, and the 1960s brought new mainland communities after the Gulf Freeway opened. A transfer on death deed recorded in the county deed records before the owner dies is one verified route that can move the house without an ordinary probate case.
On the ground
The first mistake out-of-towners make is treating Galveston County as Galveston. Galveston Bay takes up nearly half the county's area, and the county keeps going across it into Texas City, League City, Dickinson, La Marque and Friendswood. Clear Creek is the Harris County line, and League City was incorporated in 1960 just across the lake from where the space center went in. Bolivar Peninsula runs northeast as a thin strip of mainland reached by the ferry that has carried cars since 1930. On the island, the grade raising lifted roughly 2,000 buildings on jackscrews between 1903 and 1911, so much of that housing sits on foundations built up on dredged sand rather than on a slab.
Comparing Probate Lead Sources in Galveston County
Galveston County is one of twelve Texas counties with a statutory probate court, and it has one: the Probate Court of Galveston County, which Estates Code 32.005 gives exclusive jurisdiction over probate proceedings whether or not they are contested. Attorneys file through eFileTexas, applications reach the county clerk, and the filed case becomes a public court record anyone can pull up in the county's Tyler Odyssey Portal through Smart Search. That docket is both late and shared: Estates Code 256.003 lets a will be offered until the fourth anniversary of the death, and any competing investor can read the same names. A transfer on death deed recorded in the county deed records before the owner dies can move a house with no ordinary probate case, so the court file never captures every inherited property. USLeadList builds its Galveston County file from death and property records, typically about five weeks after a death, without waiting for a filing and independent of whether one is ever opened, and each lead goes to no more than three subscribers.
How Texas rules shape Galveston leads
Verified state research, applied locally.Texas has no estate tax and no inheritance tax, the inheritance tax having been repealed effective September 1, 2015. The 10 percent appraisal cap expires on January 1 of the first tax year in which neither the owner when the limitation took effect nor that owner's spouse or surviving spouse qualifies for a Section 11.13 exemption (Tax Code 23.23(c)), and the exemptions lost are substantial, including $140,000 of appraised value exempt from school district tax under Tax Code 11.13(b). The school tax ceiling an owner aged 65 or older held under Tax Code 11.26 passes only to a surviving spouse aged 55 or older who keeps the home, never to a child. An heir property owner who occupies the house is considered the sole recipient of any exemption granted for that residence homestead (Tax Code 11.13(h)) and the sole owner for qualification (Tax Code 11.41(c)), and can apply without clear title, on a death certificate and a utility bill, because the application form may not require an heir property owner to produce a recorded instrument (Tax Code 11.43(o) and (o-1)). The squeeze lands on non occupying heirs, who lose the exemptions and the cap and pay on a full market appraisal.
Ways property can avoid probate
Transfer on death deed under Estates Code Chapter 114, in force since September 1, 2015 and effective only if recorded in the county deed records before the transferor's death. Also the Lady Bird or enhanced life estate deed, probate of a will as a muniment of title under Estates Code 257.001 where the estate owes no unpaid debt other than a lien on real estate, and the Estates Code 205.001 small estate affidavit.
Small-estate route
Small estate affidavit under Estates Code 205.001, available only where the decedent died intestate, 30 days have elapsed since death, no petition to appoint a personal representative is pending or has been granted, and estate assets excluding homestead and exempt property do not exceed $75,000, a figure set by 2017 House Bill 2271 effective September 1, 2017. Estates Code 205.008(b) keeps the affidavit from transferring real property, with one exception: under 205.006 it may pass title to the homestead where the homestead is the only real property in the estate and the affidavit is recorded in the deed records.
Timing that affects the public record
Statutory floor: within one month after receiving letters the personal representative must publish notice to creditors in a newspaper of general circulation in the county where the letters were issued (Estates Code 308.051), and within two months must give notice to each known secured creditor (308.053). Texas imposes no general creditor claim period; a 121 day bar applies only to an unsecured creditor the representative chooses to notify under 308.054, so an independent administration is not held open by a statewide claim window. A will may not be admitted to probate after the fourth anniversary of the testator's death unless the applicant shows they were not in default (256.003). The small estate affidavit is usable 30 days after death (205.001). No Texas judiciary source publishes a typical duration.
Where court cases can be checked
No free statewide trial court search. re:SearchTX is the statewide index of e-filed trial court records and sits behind a sign in. The Case Search at search.txcourts.gov is the appellate TAMES system covering the Supreme Court, the Court of Criminal Appeals and the courts of appeals, and it holds no trial court cases. Failing those, the county clerk's own online records.
Why pre-probate
Why pre-probate leads in Galveston County, Texas?A public probate list requires a filed case. Our source does not require a filing and may precede a later filing, but that is not guaranteed.
Inheritance creates a property decision
A death does not guarantee a sale. It does create practical decisions about upkeep, distance, taxes, repairs and whether anyone in the family wants the property.
Earlier than a court filing
When probate is required, the public case begins after the death and after someone files. Our county records begin with the death record itself.
Not limited to probate cases
Trusts, survivorship ownership and state-specific transfer instruments can move a property without an ordinary probate case. Court-only lists do not identify those paths.
Property data with optional contact enrichment
Size, location, value, and tax information come with the property record. Phone, email, spouse, and relative data are available through the skip tracing add-on.
What we mean by pre-probate
Pre-probate > probate. Here's why.Our Galveston County data is not a court probate list. It identifies inherited-property records from deaths, including properties that may later enter probate and properties that never do.
The court docket is only one transfer path.
A trust, survivorship ownership or an authorized transfer deed may keep a property out of an ordinary probate case. The exact rules vary by state, which is why the local court and transfer details above matter.
An inheritance creates choices, not a guaranteed sale:
- Keep or occupy the property
- Rent it or transfer it within the family
- Sell it privately or through a public listing
