Inside Polk County
What the data looks like here.Iowa's capital county is one of the deepest files we carry: 56 months of tracked pre-probate and inheritance data for Polk County. A typical month adds 154 records, built from death and property records without waiting for a probate filing.
Why investors work Polk County
Iowa has no transfer on death deed for real estate, so an heir who wants to move a Polk County house without an ordinary probate case has to use a revocable trust or joint tenancy with right of survivorship instead. The tax triggers that force a fast sale in other states are missing here: Iowa's estate tax has not applied to deaths since 2005, and the inheritance tax does not reach deaths on or after January 1, 2025. Nothing in the code pushes an estate out the door, so the family decides whether to hold, rent or sell. Because there is no recorded deed instrument to route around the courthouse, an inherited Polk County property usually surfaces through a district court file, and the heir is weighing a home whose carrying cost did not change the day the owner died.
On the ground
The Des Moines River split the young city into an East and a West side, and the National Park Service's historic context notes it stayed a natural barrier while Des Moines had few bridges. In 1890 the city annexed ten surrounding suburban towns and doubled its physical size, and those Victorian communities kept their own character. The same document describes plats of small lots that drew working-class homeowners and large lots in picturesque areas that drew wealthier buyers. An investor working Polk County should learn which side of the river a house sits on and which era its plat came from before assuming one repair budget or one buyer pool fits the whole county.
Comparing Probate Lead Sources in Polk County
Polk County estates are filed in the Iowa District Court for Polk County, and the clerk of the district court keeps the probate docket; attorneys file through EDMS, and the docket is public through Iowa Courts Online Search, so any other investor in the metro can pull the same filed estate by name. The clock is slow after that: Iowa Code 633.304 requires publication once a week for two consecutive weeks, and 633.410 bars most creditor claims four months after the second publication. Neither Iowa shortcut reaches real estate, since the 633.356 affidavit covers personal property only and cannot be used until 40 days after death, and chapter 635 small-estate administration still needs a petition and letters of appointment. USLeadList works the other end: the Polk County file is built from death and property records, typically about five weeks after a death, without waiting for a probate filing and without being limited to estates that ever reach the docket. A filed case is useful, but it is a later, shared public starting point; each lead goes to no more than three subscribers.
How Iowa rules shape Polk leads
Verified state research, applied locally.Iowa has no transfer on death deed for real estate, which is the fact that matters most here. Chapter 633F of the Iowa Code is the Iowa Uniform Custodial Trust Act, not a transfer on death act, and there is no chapter 561B. The Uniform Real Property Transfer on Death Act exists only as bills that went nowhere in the 91st General Assembly: House File 125, which would create a new chapter 633G, sat in House Judiciary after a subcommittee recommended passage on February 6, 2025, and its Senate companion, Senate File 408, was introduced on February 20, 2025 and referred to Senate Judiciary, where a subcommittee was assigned on February 25, 2025. Neither passed. Iowa also imposes no death tax that would pressure a sale, since the estate tax has not applied to deaths on or after January 1, 2005 and the inheritance tax does not apply to deaths on or after January 1, 2025, and there is no reassessment on transfer. With no deed instrument to route around the courthouse, inherited Iowa real estate usually surfaces in a court file.
Ways property can avoid probate
Revocable living trust and joint tenancy with right of survivorship, plus transfer on death registration of securities under Iowa Code chapter 633D and the personal property affidavit under Iowa Code 633.356. Iowa does not authorize a transfer on death deed for real estate.
Small-estate route
Two routes, and only one is an affidavit. Distribution of property by affidavit under Iowa Code 633.356 applies where the gross value of the decedent's personal property that would pass by will or intestate succession is $50,000 or less and there is no real property, usable 40 days after death; for deaths before January 1, 2025 real property could still be present if it passed to inheritance tax exempt joint tenants with full rights of survivorship. Administration of small estates under Iowa Code chapter 635 applies where the gross value of probate assets does not exceed $200,000 (Iowa Code 635.1); it has no real property restriction, but it is a court administration with letters of appointment rather than an affidavit shortcut.
Timing that affects the public record
On admission of a will to probate the executor publishes notice once each week for two consecutive weeks in a newspaper of general circulation in the county where the estate is pending (Iowa Code 633.304). Claims are forever barred unless filed with the clerk within the later of 4 months after the date of the second publication or, for a claimant whose identity is reasonably ascertainable, one month after service of notice by ordinary mail (Iowa Code 633.410(1)). Medicaid estate recovery claims run 6 months from electronic notice to the designated agency (633.410(2)). The 633.356 affidavit cannot be used until 40 days after death. No Iowa court publishes a typical duration.

Why pre-probate
Why pre-probate leads in Polk County, Iowa?A public probate list requires a filed case. Our source does not require a filing and may precede a later filing, but that is not guaranteed.
Inheritance creates a property decision
A death does not guarantee a sale. It does create practical decisions about upkeep, distance, taxes, repairs and whether anyone in the family wants the property.
Earlier than a court filing
When probate is required, the public case begins after the death and after someone files. Our county records begin with the death record itself.
Not limited to probate cases
Trusts, survivorship ownership and state-specific transfer instruments can move a property without an ordinary probate case. Court-only lists do not identify those paths.
Property data with optional contact enrichment
Size, location, value, and tax information come with the property record. Phone, email, spouse, and relative data are available through the skip tracing add-on.
What we mean by pre-probate
Pre-probate > probate. Here's why.Our Polk County data is not a court probate list. It identifies inherited-property records from deaths, including properties that may later enter probate and properties that never do.
The court docket is only one transfer path.
A trust, survivorship ownership or an authorized transfer deed may keep a property out of an ordinary probate case. The exact rules vary by state, which is why the local court and transfer details above matter.
An inheritance creates choices, not a guaranteed sale:
- Keep or occupy the property
- Rent it or transfer it within the family
- Sell it privately or through a public listing
