Inside El Paso County

What the data looks like here.

El Paso County's pre-probate and inheritance data has run for 55 months, since March 2022, and adds about 232 records in a typical month. Each county goes to no more than three subscribers, so it stays scarce in a way a public court docket never is.

Why investors work El Paso County

Non-occupying heirs in Texas lose the residence homestead exemption, and on the school district side alone that exemption shelters $140,000 of appraised value under Tax Code 11.13. The school tax ceiling an owner aged 65 or older earned under 11.26 never passes to a child; only a surviving spouse of 55 or older who keeps the house inherits it. An heir who moves in can file for the homestead on a death certificate and a utility bill, without clear title, because the application form may not demand a recorded instrument. Texas also allows a transfer on death deed, recorded before the owner dies, so a house can pass without an ordinary probate case. That is why inheritance here is a holding-cost decision as much as a sale decision.

On the ground

Manhattan Heights began as a copper smelter tract, was platted in 1912, and filled fast with bungalows for middle-income buyers on long blocks between Louisiana and Piedras, while the elite Castle Heights addition took the south edge. SAH Archipedia records that as El Paso's population doubled in each early twentieth century decade, growth spread northeast away from the river onto the gently sloping land between the mountains and Fort Bliss. That push still sorts county property by era: central historic blocks hold century-old houses with a different maintenance profile than later northeast subdivisions. Sort a lead by which wave of that expansion it sits in before pricing it.

Comparing Probate Lead Sources in El Paso County

El Paso is one of twelve Texas counties with statutory probate courts, and it has two: Probate Court No. 1 and Probate Court No. 2. Attorneys file through eFileTexas, and anyone can pull the resulting estates from the county's Civil, Family and Probate Case Records search once a case exists. That search is useful and public, which also means competing investors are looking at the same names. The small estate route under Estates Code 205 does not avoid the clerk: the affidavit is a court filing, and 205.008(b) bars it from moving real property except a homestead that is the estate's only real estate and is recorded in the deed records. A transfer on death deed under Chapter 114 is the genuinely non-court route, because it must be recorded in the deed records before the owner dies. USLeadList works from death and property records instead, typically about five weeks after a death, without waiting for a probate filing and whether or not one ever opens, and the county file is capped at three subscribers.

How Texas rules shape El Paso leads

Verified state research, applied locally.

Texas has no estate tax and no inheritance tax, the inheritance tax having been repealed effective September 1, 2015. The 10 percent appraisal cap expires on January 1 of the first tax year in which neither the owner when the limitation took effect nor that owner's spouse or surviving spouse qualifies for a Section 11.13 exemption (Tax Code 23.23(c)), and the exemptions lost are substantial, including $140,000 of appraised value exempt from school district tax under Tax Code 11.13(b). The school tax ceiling an owner aged 65 or older held under Tax Code 11.26 passes only to a surviving spouse aged 55 or older who keeps the home, never to a child. An heir property owner who occupies the house is considered the sole recipient of any exemption granted for that residence homestead (Tax Code 11.13(h)) and the sole owner for qualification (Tax Code 11.41(c)), and can apply without clear title, on a death certificate and a utility bill, because the application form may not require an heir property owner to produce a recorded instrument (Tax Code 11.43(o) and (o-1)). The squeeze lands on non occupying heirs, who lose the exemptions and the cap and pay on a full market appraisal.

01

Ways property can avoid probate

Transfer on death deed under Estates Code Chapter 114, in force since September 1, 2015 and effective only if recorded in the county deed records before the transferor's death. Also the Lady Bird or enhanced life estate deed, probate of a will as a muniment of title under Estates Code 257.001 where the estate owes no unpaid debt other than a lien on real estate, and the Estates Code 205.001 small estate affidavit.

02

Small-estate route

Small estate affidavit under Estates Code 205.001, available only where the decedent died intestate, 30 days have elapsed since death, no petition to appoint a personal representative is pending or has been granted, and estate assets excluding homestead and exempt property do not exceed $75,000, a figure set by 2017 House Bill 2271 effective September 1, 2017. Estates Code 205.008(b) keeps the affidavit from transferring real property, with one exception: under 205.006 it may pass title to the homestead where the homestead is the only real property in the estate and the affidavit is recorded in the deed records.

03

Timing that affects the public record

Statutory floor: within one month after receiving letters the personal representative must publish notice to creditors in a newspaper of general circulation in the county where the letters were issued (Estates Code 308.051), and within two months must give notice to each known secured creditor (308.053). Texas imposes no general creditor claim period; a 121 day bar applies only to an unsecured creditor the representative chooses to notify under 308.054, so an independent administration is not held open by a statewide claim window. A will may not be admitted to probate after the fourth anniversary of the testator's death unless the applicant shows they were not in default (256.003). The small estate affidavit is usable 30 days after death (205.001). No Texas judiciary source publishes a typical duration.

04

Where court cases can be checked

No free statewide trial court search. re:SearchTX is the statewide index of e-filed trial court records and sits behind a sign in. The Case Search at search.txcourts.gov is the appellate TAMES system covering the Supreme Court, the Court of Criminal Appeals and the courts of appeals, and it holds no trial court cases. Failing those, the county clerk's own online records.

A court-file list covers only estates that reach a public probate case. USLeadList starts with death and property matching instead of waiting for that filing.

Why pre-probate

Why pre-probate leads in El Paso County, Texas?

A public probate list requires a filed case. Our source does not require a filing and may precede a later filing, but that is not guaranteed.

01

Inheritance creates a property decision

A death does not guarantee a sale. It does create practical decisions about upkeep, distance, taxes, repairs and whether anyone in the family wants the property.

02

Earlier than a court filing

When probate is required, the public case begins after the death and after someone files. Our county records begin with the death record itself.

03

Not limited to probate cases

Trusts, survivorship ownership and state-specific transfer instruments can move a property without an ordinary probate case. Court-only lists do not identify those paths.

04

Property data with optional contact enrichment

Size, location, value, and tax information come with the property record. Phone, email, spouse, and relative data are available through the skip tracing add-on.

What we mean by pre-probate

Pre-probate > probate. Here's why.

Our El Paso County data is not a court probate list. It identifies inherited-property records from deaths, including properties that may later enter probate and properties that never do.

The court docket is only one transfer path.

A trust, survivorship ownership or an authorized transfer deed may keep a property out of an ordinary probate case. The exact rules vary by state, which is why the local court and transfer details above matter.

An inheritance creates choices, not a guaranteed sale:

  • Keep or occupy the property
  • Rent it or transfer it within the family
  • Sell it privately or through a public listing
