Inherited real property therefore normally does reach the court record unless it was placed in a living trust or held in tenancy by the entirety or with right of survivorship. Nothing pushes an heir to sell: the Department of Revenue no longer imposes the inheritance tax for deaths after December 31, 2015, and Tennessee has no estate tax.

The small estate route is separate: a petition for limited letters may not be filed until 45 days after the death, and it is available only where the estate is $50,000 or less and no real property is involved (T.C.A. 30-4-103 as rewritten by Public Chapter 297 of 2023, and T.C.A. 30-4-102, which defines the property it reaches as personal property only). Shelby County Probate Court requires the inventory and the TennCare affidavit within 60 days of appointment and the first accounting at 15 months, and tells personal representatives that most estates can be closed within thirteen months.
