Inside Davidson County
What the data looks like here.Davidson County is covered, and we sell pre-probate and inheritance data here: about 160 new records a month, drawn from death and property records without waiting for a probate filing. Each lead goes to no more than three subscribers.
Why investors work Davidson County
Davidson County grew outward after World War II, when residents left Nashville's older urban neighborhoods for new suburban houses built across the county. Tennessee gives an heir no easy exit from that property. There is no transfer-on-death deed for real property, and the small estate procedure reaches personal property only, so a house generally does reach the probate record unless it sat in a living trust or was held with survivorship. Nothing forces a sale either: the state's inheritance tax ended for deaths after 2015. What an heir weighs is keeping, renting or selling a paid-off house, not beating a tax deadline.
On the ground
Metro is the thing out-of-town buyers get wrong. Nashville and Davidson County merged in 1963 into the first fully unified city-county government in the country, and the charter split the county into two tax districts: the Urban Services District pays for full city services, while the General Services District carried a lower rate until services arrived. Six communities kept their own charters, police and zoning inside the county line: Belle Meade, Berry Hill, Oak Hill, Forest Hills, Goodlettsville and Lakewood. A house inside Oak Hill or Belle Meade is not taxed or zoned like one just outside those lines, so pull the parcel's district and municipality before you price it.
Comparing Probate Lead Sources in Davidson County
Davidson County probate runs through the Seventh Circuit Court, Probate Division, which the Circuit Court Clerk describes as holding exclusive jurisdiction over estate administration here, with the Probate Court Clerk handling the filings. Filed estates are public: the clerk offers free CaseSearch lookups and a subscription CaseLink service, so any investor can pull the same names once a case is opened. The Small Estate Probate Act cannot be filed until 45 days after death, and it reaches personal property only, so it never transfers a house. That is the ceiling on the docket: it begins at filing and covers only the estates someone chose to open. USLeadList builds its Davidson County file from death and property records, typically about five weeks after a death and often before a later filing, without depending on a case ever being opened.
How Tennessee rules shape Davidson leads
Verified state research, applied locally.Tennessee authorizes no transfer-on-death deed for real property. SB 660 and HB 1600 of 2021, which would have enacted the Tennessee Uniform Real Property Transfer on Death Act, died in subcommittee, HB 1600 in a House subcommittee. Successor bills captioned to enact the same uniform act were filed and also died: SB 984, filed February 5, 2025, after second consideration in Senate Judiciary; HB 1793, filed January 21, 2026, whose sponsors were withdrawn on February 25, 2026 after it went to the House Civil Justice Subcommittee; and its companion SB 2029, filed January 22, 2026, after second consideration in Senate Judiciary. The act has now failed in 2021, 2025 and 2026. The Small Estate Probate Act defines the property it reaches as personal property only, so it cannot pass a house (T.C.A. 30-4-102, Public Chapter 297 of 2023). Inherited real property therefore normally does reach the court record unless it was placed in a living trust or held in tenancy by the entirety or with right of survivorship. Nothing pushes an heir to sell: the Department of Revenue no longer imposes the inheritance tax for deaths after December 31, 2015, and Tennessee has no estate tax.
Ways property can avoid probate
Living trust, and joint ownership in tenancy by the entirety or with right of survivorship. Tennessee has no transfer-on-death deed, and its small estate procedure reaches personal property only.
Small-estate route
Small estate administration under the Small Estate Probate Act, by limited letters of administration or limited letters testamentary, where the value of the probate property does not exceed $50,000 and 45 days have passed since death with no petition for a personal representative filed; property is defined as personal property only, so the procedure cannot pass real estate (T.C.A. 30-4-102 and 30-4-103, as rewritten by Public Chapter 297 of 2023)
Timing that affects the public record
The personal representative publishes notice to creditors under T.C.A. 30-2-306, and all claims must be filed in the office of the county clerk within four months from the first date of publication of that notice (Rutherford County Probate Court). That window is the real floor on how fast an estate can close. The small estate route is separate: a petition for limited letters may not be filed until 45 days after the death, and it is available only where the estate is $50,000 or less and no real property is involved (T.C.A. 30-4-103 as rewritten by Public Chapter 297 of 2023, and T.C.A. 30-4-102, which defines the property it reaches as personal property only). Shelby County Probate Court requires the inventory and the TennCare affidavit within 60 days of appointment and the first accounting at 15 months, and tells personal representatives that most estates can be closed within thirteen months.
Where court cases can be checked
none statewide for trial courts. Public Case History at the Administrative Office of the Courts searches appellate cases only, so probate records are obtained from the clerk and master, probate court clerk or circuit court clerk of the county where the estate was opened
Why pre-probate
Why pre-probate leads in Davidson County, Tennessee?A public probate list requires a filed case. Our source does not require a filing and may precede a later filing, but that is not guaranteed.
Inheritance creates a property decision
A death does not guarantee a sale. It does create practical decisions about upkeep, distance, taxes, repairs and whether anyone in the family wants the property.
Earlier than a court filing
When probate is required, the public case begins after the death and after someone files. Our county records begin with the death record itself.
Not limited to probate cases
Trusts, survivorship ownership and state-specific transfer instruments can move a property without an ordinary probate case. Court-only lists do not identify those paths.
Property data with optional contact enrichment
Size, location, value, and tax information come with the property record. Phone, email, spouse, and relative data are available through the skip tracing add-on.
What we mean by pre-probate
Pre-probate > probate. Here's why.Our Davidson County data is not a court probate list. It identifies inherited-property records from deaths, including properties that may later enter probate and properties that never do.
The court docket is only one transfer path.
A trust, survivorship ownership or an authorized transfer deed may keep a property out of an ordinary probate case. The exact rules vary by state, which is why the local court and transfer details above matter.
An inheritance creates choices, not a guaranteed sale:
- Keep or occupy the property
- Rent it or transfer it within the family
- Sell it privately or through a public listing
