Inside Hamilton County

What the data looks like here.

Hamilton County's pre-probate and inheritance data adds about 139 records a month. It comes from death and property records rather than a court filing, so an inherited Chattanooga home surfaces without waiting on probate, and no lead goes to more than three subscribers.

Why investors work Hamilton County

Tennessee authorizes no transfer-on-death deed for real property, and bills to create one died in 2021, 2025 and again in 2026. The state's small estate route is narrower than the name suggests: it reaches personal property only, so it cannot pass a house. Inherited real estate in Hamilton County therefore usually lands in a Chancery Court file unless it sat in a living trust or was held with survivorship. Nothing here pressures an heir to sell, since the Department of Revenue stopped imposing the inheritance tax for deaths after 2015 and Tennessee has no estate tax. With no deed shortcut and no tax deadline, whether to keep or sell the house is the heir's own call, made on no fixed timetable.

On the ground

Ooltewah, Apison and Collegedale sit on ground that was once James County, carved from Hamilton and Bradley in 1871 and bankrupt by 1919, and the old James County Courthouse in Ooltewah is on the National Register. Chattanooga and Hamilton County operate under separate governments, and the county holds nine municipalities, so the entity answering your tax, code and school questions changes from one address to the next. Dallas and the old river town of Harrison vanished under Lake Chickamauga in 1939 when the TVA dams went in. An investor pricing anything east of Chattanooga should first establish which municipality and which school district carry the parcel.

Comparing Probate Lead Sources in Hamilton County

Hamilton County probate sits in Part 2 of the Chancery Court for the Eleventh Judicial District, where Public Acts of 1955, Chapter 201 gave that part exclusive jurisdiction over wills and estates, and the Clerk and Master keeps the files. Filings arrive by email under a local order adopting Supreme Court Rule 46(B), and both full administration and a muniment of title petition open a numbered case. Those case files are public court records, so a competing investor can request the same estate you can. That record is useful, but it exists only once someone files, which is weeks or months after a death. USLeadList builds the inherited-property file here from death and property records instead, typically about five weeks after a death, without waiting for a filing and independent of whether one is ever opened.

How Tennessee rules shape Hamilton leads

Verified state research, applied locally.

Tennessee authorizes no transfer-on-death deed for real property. SB 660 and HB 1600 of 2021, which would have enacted the Tennessee Uniform Real Property Transfer on Death Act, died in subcommittee, HB 1600 in a House subcommittee. Successor bills captioned to enact the same uniform act were filed and also died: SB 984, filed February 5, 2025, after second consideration in Senate Judiciary; HB 1793, filed January 21, 2026, whose sponsors were withdrawn on February 25, 2026 after it went to the House Civil Justice Subcommittee; and its companion SB 2029, filed January 22, 2026, after second consideration in Senate Judiciary. The act has now failed in 2021, 2025 and 2026. The Small Estate Probate Act defines the property it reaches as personal property only, so it cannot pass a house (T.C.A. 30-4-102, Public Chapter 297 of 2023). Inherited real property therefore normally does reach the court record unless it was placed in a living trust or held in tenancy by the entirety or with right of survivorship. Nothing pushes an heir to sell: the Department of Revenue no longer imposes the inheritance tax for deaths after December 31, 2015, and Tennessee has no estate tax.

01

Ways property can avoid probate

Living trust, and joint ownership in tenancy by the entirety or with right of survivorship. Tennessee has no transfer-on-death deed, and its small estate procedure reaches personal property only.

02

Small-estate route

Small estate administration under the Small Estate Probate Act, by limited letters of administration or limited letters testamentary, where the value of the probate property does not exceed $50,000 and 45 days have passed since death with no petition for a personal representative filed; property is defined as personal property only, so the procedure cannot pass real estate (T.C.A. 30-4-102 and 30-4-103, as rewritten by Public Chapter 297 of 2023)

03

Timing that affects the public record

The personal representative publishes notice to creditors under T.C.A. 30-2-306, and all claims must be filed in the office of the county clerk within four months from the first date of publication of that notice (Rutherford County Probate Court). That window is the real floor on how fast an estate can close. The small estate route is separate: a petition for limited letters may not be filed until 45 days after the death, and it is available only where the estate is $50,000 or less and no real property is involved (T.C.A. 30-4-103 as rewritten by Public Chapter 297 of 2023, and T.C.A. 30-4-102, which defines the property it reaches as personal property only). Shelby County Probate Court requires the inventory and the TennCare affidavit within 60 days of appointment and the first accounting at 15 months, and tells personal representatives that most estates can be closed within thirteen months.

04

Where court cases can be checked

none statewide for trial courts. Public Case History at the Administrative Office of the Courts searches appellate cases only, so probate records are obtained from the clerk and master, probate court clerk or circuit court clerk of the county where the estate was opened

A court-file list covers only estates that reach a public probate case. USLeadList starts with death and property matching instead of waiting for that filing.

Why pre-probate

Why pre-probate leads in Hamilton County, Tennessee?

A public probate list requires a filed case. Our source does not require a filing and may precede a later filing, but that is not guaranteed.

01

Inheritance creates a property decision

A death does not guarantee a sale. It does create practical decisions about upkeep, distance, taxes, repairs and whether anyone in the family wants the property.

02

Earlier than a court filing

When probate is required, the public case begins after the death and after someone files. Our county records begin with the death record itself.

03

Not limited to probate cases

Trusts, survivorship ownership and state-specific transfer instruments can move a property without an ordinary probate case. Court-only lists do not identify those paths.

04

Property data with optional contact enrichment

Size, location, value, and tax information come with the property record. Phone, email, spouse, and relative data are available through the skip tracing add-on.

What we mean by pre-probate

Pre-probate > probate. Here's why.

Our Hamilton County data is not a court probate list. It identifies inherited-property records from deaths, including properties that may later enter probate and properties that never do.

The court docket is only one transfer path.

A trust, survivorship ownership or an authorized transfer deed may keep a property out of an ordinary probate case. The exact rules vary by state, which is why the local court and transfer details above matter.

An inheritance creates choices, not a guaranteed sale:

  • Keep or occupy the property
  • Rent it or transfer it within the family
  • Sell it privately or through a public listing

FAQ

Hamilton County-specific questions.
How many Hamilton County pre-probate records can I get each month?
About 139 in a typical month, and 133 on average across the last twelve months. The slowest tracked month produced 76 and the peak reached 178, across 56 months of history.
Are Hamilton County probate case files open to the public?
Yes. The Clerk and Master keeps the Chancery Court Part 2 probate files, and they are public court records, so a competing investor can request the same estate you can.
Does a Tennessee muniment of title keep a house out of court?
No. It is a petition filed in Chancery Court Part 2 and appears on the Clerk and Master's forms beside full administration. Tennessee has no transfer-on-death deed, so a house outside a trust or survivorship still reaches a court file.
Do you have leads for Chattanooga, Tennessee?
The county file covers qualifying properties throughout Hamilton County, including Chattanooga. Record counts vary by month and are not guaranteed for one city.
How do I work these leads in Hamilton County?
Begin with a simple, respectful letter that identifies the property and explains why you are writing. Use a measured follow-up sequence, honor opt-outs, and follow the marketing rules that apply to your channel. Phone and email enrichment is available as an add-on.
Why purchase from USLeadList?
USLeadList matches death records with property records. Each monthly file is checked against MLS data to remove properties already sold. The same lead is delivered to no more than three USLeadList subscribers. This is limited distribution, not market-wide exclusivity or protection from other data sources.
Who uses USLeadList pre-probate leads?
Real estate investors, wholesalers, flippers, and agents looking for inherited-property opportunities.
