Inside Providence County

What the data looks like here.

Providence County has no single probate court to call, because every city and town here runs a separate one. Our pre-probate and inheritance data is built from death and property records without waiting for a filing, averaging 143 records a month with a tracked peak of 781.

Why investors work Providence County

Rhode Island hands an heir no shortcut deed. The General Laws authorize no transfer on death deed for real estate, and the voluntary informal route reaches only personal property up to $15,000, so it cannot carry a house. Title held in a revocable living trust or as joint tenants with right of survivorship is different, since both pass outside an ordinary probate case. Where nothing was held that way, the state estate tax lien rides on the estate until it is paid, the tax administrator can have the recorder of deeds note it against the decedent's real property in the land records, and it runs no longer than ten years past the death. Even an estate that owes nothing files a Rhode Island estate tax return to clear that lien, and the paperwork gap is when the keep, rent or sell decision actually gets made.

On the ground

Rhode Island Historical Society research puts 1890 Providence at only about half one-family dwellings, with over 40 percent two-family, the highest share among large American cities. The Rhode Island Historical Preservation Commission's Smith Hill survey traces the three-deckers to speculative builders who ran near-identical rows from the 1890s to 1930, densest along Oakland Avenue. The city's first Irish parish set St. Patrick's on Smith Hill in 1842, after its committee found East Side and downtown sites too expensive. So the unit mix is part of the deal on an inherited Providence property, and occupancy deserves as much diligence as the deed.

Comparing Probate Lead Sources in Providence County

Providence County has no probate court of its own, because Rhode Island probate is municipal: each city and town in the county runs its own court under Title 8 of the General Laws, and Cranston and Providence keep separate files. Filings go to that court directly, and the Judiciary's Public Portal reaches only the Supreme, Superior, Family, District, Workers' Compensation and Traffic Tribunal dockets, so there is no statewide probate search. Creditors must present claims within six months of the first published notice or be barred, and the voluntary informal route cannot be filed until 30 days after death and reaches $15,000 of personal property only, never a house. A filed estate is a public record at the city or town clerk's office, useful but shared: any other investor can request that same file. USLeadList identifies inherited Providence County property from death and property records without waiting for a filing, typically about five weeks after the death and often before one, and no lead goes to more than three subscribers.

How Rhode Island rules shape Providence leads

Verified state research, applied locally.

Rhode Island does not push heirs to sell, but very little escapes the courthouse. There is no transfer on death deed: Title 34 of the General Laws contains no such chapter, and the Uniform Real Property Transfer on Death Act exists only as a bill, most recently 2025-S 0141 of the 2025 session, which would add a new chapter 33-4.1. The small estate route reaches $15,000 of personal property only (RIGL 33-24-1), so a house does not qualify. An automatic statutory lien also attaches at death to the estate (RIGL 44-23-9), and on the real property side the tax administrator notifies the recorder of deeds, who notes in the land records that all real property belonging to the decedent is impressed with the lien (RIGL 44-23-12). It runs until the tax is paid or until ten years after the death, whichever comes first (RIGL 44-23-38), so estates that owe nothing still file a Rhode Island estate tax return with Form T-77 to discharge it before title clears. The gross estate filing threshold is $1,802,431 for deaths on or after January 1, 2025 and $1,838,056 for deaths on or after January 1, 2026.

01

Ways property can avoid probate

Revocable living trust and joint tenancy with right of survivorship, plus payable on death registration on financial accounts. Rhode Island does not authorize a transfer on death deed for real estate, and the voluntary informal administration at RIGL 33-24-1 covers personal property only.

02

Small-estate route

Voluntary informal administration under RIGL 33-24-1, available where the estate consists entirely of personal property not exceeding $15,000 in value, exclusive of tangible personal property of which the decedent was owner, and no formal proceedings have begun, usable 30 days after the death of the decedent. Real estate is not covered, so an inherited house cannot pass this way.

03

Timing that affects the public record

Claims must be presented within 6 months from the first publication of notice or be forever barred (RIGL 33-11-5(a)), and notice of the commencement of probate given at least 60 days before that period expires satisfies the adequate notice requirement (RIGL 33-11-5(b)). The voluntary informal administration statement cannot be filed until 30 days after death (RIGL 33-24-1). Separately, a Rhode Island estate tax return with Form T-77 is used to discharge the statutory lien on real estate before clear title will pass. No Rhode Island court publishes a typical duration.

04

Where court cases can be checked

no statewide online case search for probate. The Rhode Island Judiciary Public Portal covers the Supreme, Superior, Family, District, Workers' Compensation and Traffic Tribunal courts only, so probate records are obtained from the clerk of the city or town probate court.

A court-file list covers only estates that reach a public probate case. USLeadList starts with death and property matching instead of waiting for that filing.

Why pre-probate

Why pre-probate leads in Providence County, Rhode Island?

A public probate list requires a filed case. Our source does not require a filing and may precede a later filing, but that is not guaranteed.

01

Inheritance creates a property decision

A death does not guarantee a sale. It does create practical decisions about upkeep, distance, taxes, repairs and whether anyone in the family wants the property.

02

Earlier than a court filing

When probate is required, the public case begins after the death and after someone files. Our county records begin with the death record itself.

03

Not limited to probate cases

Trusts, survivorship ownership and state-specific transfer instruments can move a property without an ordinary probate case. Court-only lists do not identify those paths.

04

Property data with optional contact enrichment

Size, location, value, and tax information come with the property record. Phone, email, spouse, and relative data are available through the skip tracing add-on.

What we mean by pre-probate

Pre-probate > probate. Here's why.

Our Providence County data is not a court probate list. It identifies inherited-property records from deaths, including properties that may later enter probate and properties that never do.

The court docket is only one transfer path.

A trust, survivorship ownership or an authorized transfer deed may keep a property out of an ordinary probate case. The exact rules vary by state, which is why the local court and transfer details above matter.

An inheritance creates choices, not a guaranteed sale:

  • Keep or occupy the property
  • Rent it or transfer it within the family
  • Sell it privately or through a public listing

FAQ

Providence County-specific questions.
How many pre-probate records does Providence County produce each month?
About 143 a month, and 142 a month on average over the last twelve months, roughly 1,700 records in all. The slowest tracked month ran 81 and the busiest hit 781, so the volume is lumpy rather than steady.
Does Providence County have its own probate court to search?
Rhode Island has no probate court at the county level, so Cranston and Providence each keep their own file with the clerk of that city or town's court. No statewide probate search reaches either one.
Can a Rhode Island house pass outside probate?
Property already held in a revocable living trust or as joint tenants with right of survivorship transfers without an ordinary probate case. The voluntary informal route covers $15,000 of personal property, so a house cannot use it.
Do you have leads for Providence, Rhode Island?
The county file covers qualifying properties throughout Providence County, including Providence. Record counts vary by month and are not guaranteed for one city.
How do I work these leads in Providence County?
Begin with a simple, respectful letter that identifies the property and explains why you are writing. Use a measured follow-up sequence, honor opt-outs, and follow the marketing rules that apply to your channel. Phone and email enrichment is available as an add-on.
Why purchase from USLeadList?
USLeadList matches death records with property records. Each monthly file is checked against MLS data to remove properties already sold. The same lead is delivered to no more than three USLeadList subscribers. This is limited distribution, not market-wide exclusivity or protection from other data sources.
Who uses USLeadList pre-probate leads?
Real estate investors, wholesalers, flippers, and agents looking for inherited-property opportunities.
