Inside Albany County

What the data looks like here.

USLeadList covers Albany County with pre-probate and inheritance data: about 75 new records a month, 83 on average over the past year. Each lead goes to at most three subscribers, and the file is built from death and property records without waiting for a probate filing.

Why investors work Albany County

Albany County stacks two housing markets on one tax roll: the city's attached brick rowhouses, most of them raised between the 1840s and the 1920s, and the suburban towns that grew as city families moved out to Loudonville, Slingerlands and Altamont. When one of those houses passes to an heir, the owner's STAR benefit is the piece that changes, because it is tied to the person who registered it and must be re-registered once ownership moves. That leaves a real carrying-cost decision: keep the house, rent it, or sell it. A transfer on death deed recorded under Real Property Law 424 can carry a house to a named beneficiary without an ordinary probate case, so inherited property in this county does not always surface as a Surrogate's Court file.

On the ground

Albany County runs from the city out through Cohoes, Watervliet, Colonie, Guilderland, Bethlehem and the rural hilltowns of Berne, Knox and Rensselaerville. Center Square and Hudson Park stand on ground that was a ravine until the Ruttenkill Creek was filled in 1845, and the filled stretch still reads as a dip along Hudson Avenue, worth checking before buying a rowhouse there. The families who owned those rowhouses had been renting them out since the 1890s, and in the 1930s many moved for good to summer places in Loudonville, Slingerlands, Altamont and Selkirk, where the county's suburban growth began. Treat the city and those towns as one market and you will misread both.

Comparing Probate Lead Sources in Albany County

Albany County estate matters are heard by the Albany County Surrogate's Court, and new proceedings there have been e-filed through NYSCEF since October 19, 2016, with guardianships, adoptions and some lifetime trust filings exempt. Filed cases are public: WebSurrogate lets anyone search by name or file number, though it posts document images only for filings made on or after February 19, 2014. New York imposes no waiting period before a probate or administration petition may be filed, and SCPA 1802 protects a fiduciary who pays claims and distributes in good faith once seven months have run from the date letters were first issued. That docket is genuinely useful, but it starts only when someone petitions, and every other investor can run the same WebSurrogate search on the same names. USLeadList identifies inherited Albany County property from death and property records instead, without waiting for a filing, often before one, and without limiting itself to estates that ever reach the Surrogate's Court.

How New York rules shape Albany leads

Verified state research, applied locally.

New York puts no recurring pressure on an heir to sell. The class 1 assessment caps in New York City and Nassau County limit annual and five year increases parcel by parcel and carry no change of ownership reset (RPTL 1805), so a tax bill does not jump because title moved, and the state has no acquisition value system. The estate tax reaches almost no one: the basic exclusion amount is $7,350,000 for 2026 deaths and $7,160,000 for 2025 deaths, and Tax Law 952 withdraws the credit entirely once the New York taxable estate exceeds 105 percent of that amount. There is no inheritance tax. The real loss to an heir is the decedent's STAR, Enhanced STAR and senior exemptions, which do not pass with the house and raise the school tax bill until the heir qualifies alone. What keeps New York houses out of Surrogate's Court is the transfer on death deed at Real Property Law 424, in effect since July 19, 2024, which needs two witnesses present at the same time, a notary, and recording in the county clerk's office before the transferor's death.

01

Ways property can avoid probate

Transfer on death deed under Real Property Law 424, in effect since July 19, 2024, requiring two witnesses present at the same time, acknowledgment before a notary, and recording before the transferor's death. Also revocable living trusts, joint ownership with right of survivorship, and SCPA Article 13 voluntary administration for personal property up to $50,000.

02

Small-estate route

SCPA Article 13, Settlement of Small Estates Without Court Administration, handled by a voluntary administrator. A small estate is one leaving personal property with a gross value of $50,000 or less, exclusive of property required to be set off under EPTL 5-3.1(a) (SCPA 1301, raised from $30,000 by L. 2019, ch. 557, effective November 25, 2019). SCPA 1302 keeps New York real property out of the procedure, but the decedent's ownership of real property does not prevent the estate from using Article 13 for the personal property.

03

Timing that affects the public record

Statutory floor: there is no waiting period before a probate or administration petition may be filed. Under SCPA 1802 a fiduciary who has paid lawful claims, legacies or distributions in good faith is not chargeable for a claim presented later than 7 months from the date letters were first issued, so that 7 month window, running from issuance of letters rather than from death, is the practical floor before an estate is distributed. SCPA 1802 protects the fiduciary rather than extinguishing a late claim. No Unified Court System source publishes a typical duration.

04

Where court cases can be checked

WebSurrogate, the free Unified Court System search of estate proceedings and other filings in New York State Surrogate's Courts. It links document images only for filings made on or after February 19, 2014 and suppresses restricted files such as guardianship and adoption. NYSCEF's Search as Guest covers e-filed matters.

A court-file list covers only estates that reach a public probate case. USLeadList starts with death and property matching instead of waiting for that filing.

Why pre-probate

Why pre-probate leads in Albany County, New York?

A public probate list requires a filed case. Our source does not require a filing and may precede a later filing, but that is not guaranteed.

01

Inheritance creates a property decision

A death does not guarantee a sale. It does create practical decisions about upkeep, distance, taxes, repairs and whether anyone in the family wants the property.

02

Earlier than a court filing

When probate is required, the public case begins after the death and after someone files. Our county records begin with the death record itself.

03

Not limited to probate cases

Trusts, survivorship ownership and state-specific transfer instruments can move a property without an ordinary probate case. Court-only lists do not identify those paths.

04

Property data with optional contact enrichment

Size, location, value, and tax information come with the property record. Phone, email, spouse, and relative data are available through the skip tracing add-on.

What we mean by pre-probate

Pre-probate > probate. Here's why.

Our Albany County data is not a court probate list. It identifies inherited-property records from deaths, including properties that may later enter probate and properties that never do.

The court docket is only one transfer path.

A trust, survivorship ownership or an authorized transfer deed may keep a property out of an ordinary probate case. The exact rules vary by state, which is why the local court and transfer details above matter.

An inheritance creates choices, not a guaranteed sale:

  • Keep or occupy the property
  • Rent it or transfer it within the family
  • Sell it privately or through a public listing

FAQ

Albany County-specific questions.
How many pre-probate and inheritance records does Albany County produce each month?
About 75 in a typical month, with 83 as the twelve month average across 997 records. The slowest tracked month was 53 and the peak was 119, so volume swings without going quiet.
Does a transfer on death deed keep an Albany County house out of Surrogate's Court?
Yes, if it is recorded in the county clerk's office before the owner dies, with two witnesses present at the same time and a notary. A house passing that way never becomes a Surrogate's Court file, which is what a docket-only search misses.
Does Albany County have its own Surrogate's Court, or share one with the county court?
It has its own. Albany County estate filings go to a dedicated Surrogate's Court rather than a combined county court docket, and new proceedings there are e-filed through NYSCEF.
Do you have leads for Albany, New York?
The county file covers qualifying properties throughout Albany County, including Albany. Record counts vary by month and are not guaranteed for one city.
How do I work these leads in Albany County?
Begin with a simple, respectful letter that identifies the property and explains why you are writing. Use a measured follow-up sequence, honor opt-outs, and follow the marketing rules that apply to your channel. Phone and email enrichment is available as an add-on.
Why purchase from USLeadList?
USLeadList matches death records with property records. Each monthly file is checked against MLS data to remove properties already sold. The same lead is delivered to no more than three USLeadList subscribers. This is limited distribution, not market-wide exclusivity or protection from other data sources.
Who uses USLeadList pre-probate leads?
Real estate investors, wholesalers, flippers, and agents looking for inherited-property opportunities.
