Inside Taylor County

What the data looks like here.

Taylor County's market runs through Abilene, and our pre-probate and inheritance data comes from death and property records rather than a court docket. Expect roughly 54 new records a month, 55 on average over the last year, and no lead sold to more than three subscribers.

Why investors work Taylor County

An inheritance in Taylor County is a carrying-cost decision before it is a sale. Texas exempts $140,000 of appraised value from school district tax on a residence homestead, and that break follows occupancy: an heir who never moves in loses it and is taxed on full market value, while one who does move in can claim it and can apply as an heir property owner without clear title. The 10 percent appraisal cap on a long-held home ends the same way, in the first tax year no qualifying owner remains. That math lands on old housing, because Abilene's register of historic properties opens with an 1882 house on Poplar Street and runs past 1960. A transfer on death deed recorded in the Taylor County deed records before death is one route that moves such a house with no ordinary probate case.

On the ground

Abilene's street grid runs north and south from the downtown rail corridor, where the T&P depot and the old Burlington station both sit on the city's register of historic properties. The two National Register districts split the same way: Parramore lies north of downtown, Sayles Boulevard to the south. Their periods of significance are not identical, since Sayles Boulevard reaches back to the 1875 to 1899 era while Parramore begins in 1900. An out-of-town buyer who treats historic Abilene as one market will miss that difference, so check a block's build date before reading a district label as a price signal.

Comparing Probate Lead Sources in Taylor County

Taylor County has no statutory probate court, so applications go to the County Clerk and are heard by the County Court, which takes most of them, or by one of the two statutory County Courts at Law when the filer asks, and those two split cases by the decedent's last name initial. Attorneys file through eFileTexas, and the Clerk's public access site indexes probates back to the late 1800s by decedent name. That index is useful and it is shared, because any other investor in the county can pull the same filed case once an application lands. Texas's small estate affidavit, usable 30 days after death, is filed with the clerk, so it is a court record, and it reaches personal property up to $75,000 rather than a house, except where a homestead is the estate's only real property and is recorded in the deed records. A recorded transfer on death deed is the cleaner non-court route for real property. USLeadList builds Taylor County pre-probate and inheritance data from death and property records, typically about five weeks after a death, without waiting for a filing and whether or not one is ever opened.

How Texas rules shape Taylor leads

Verified state research, applied locally.

Texas has no estate tax and no inheritance tax, the inheritance tax having been repealed effective September 1, 2015. The 10 percent appraisal cap expires on January 1 of the first tax year in which neither the owner when the limitation took effect nor that owner's spouse or surviving spouse qualifies for a Section 11.13 exemption (Tax Code 23.23(c)), and the exemptions lost are substantial, including $140,000 of appraised value exempt from school district tax under Tax Code 11.13(b). The school tax ceiling an owner aged 65 or older held under Tax Code 11.26 passes only to a surviving spouse aged 55 or older who keeps the home, never to a child. An heir property owner who occupies the house is considered the sole recipient of any exemption granted for that residence homestead (Tax Code 11.13(h)) and the sole owner for qualification (Tax Code 11.41(c)), and can apply without clear title, on a death certificate and a utility bill, because the application form may not require an heir property owner to produce a recorded instrument (Tax Code 11.43(o) and (o-1)). The squeeze lands on non occupying heirs, who lose the exemptions and the cap and pay on a full market appraisal.

01

Ways property can avoid probate

Transfer on death deed under Estates Code Chapter 114, in force since September 1, 2015 and effective only if recorded in the county deed records before the transferor's death. Also the Lady Bird or enhanced life estate deed, probate of a will as a muniment of title under Estates Code 257.001 where the estate owes no unpaid debt other than a lien on real estate, and the Estates Code 205.001 small estate affidavit.

02

Small-estate route

Small estate affidavit under Estates Code 205.001, available only where the decedent died intestate, 30 days have elapsed since death, no petition to appoint a personal representative is pending or has been granted, and estate assets excluding homestead and exempt property do not exceed $75,000, a figure set by 2017 House Bill 2271 effective September 1, 2017. Estates Code 205.008(b) keeps the affidavit from transferring real property, with one exception: under 205.006 it may pass title to the homestead where the homestead is the only real property in the estate and the affidavit is recorded in the deed records.

03

Timing that affects the public record

Statutory floor: within one month after receiving letters the personal representative must publish notice to creditors in a newspaper of general circulation in the county where the letters were issued (Estates Code 308.051), and within two months must give notice to each known secured creditor (308.053). Texas imposes no general creditor claim period; a 121 day bar applies only to an unsecured creditor the representative chooses to notify under 308.054, so an independent administration is not held open by a statewide claim window. A will may not be admitted to probate after the fourth anniversary of the testator's death unless the applicant shows they were not in default (256.003). The small estate affidavit is usable 30 days after death (205.001). No Texas judiciary source publishes a typical duration.

04

Where court cases can be checked

No free statewide trial court search. re:SearchTX is the statewide index of e-filed trial court records and sits behind a sign in. The Case Search at search.txcourts.gov is the appellate TAMES system covering the Supreme Court, the Court of Criminal Appeals and the courts of appeals, and it holds no trial court cases. Failing those, the county clerk's own online records.

A court-file list covers only estates that reach a public probate case. USLeadList starts with death and property matching instead of waiting for that filing.

Why pre-probate

Why pre-probate leads in Taylor County, Texas?

A public probate list requires a filed case. Our source does not require a filing and may precede a later filing, but that is not guaranteed.

01

Inheritance creates a property decision

A death does not guarantee a sale. It does create practical decisions about upkeep, distance, taxes, repairs and whether anyone in the family wants the property.

02

Earlier than a court filing

When probate is required, the public case begins after the death and after someone files. Our county records begin with the death record itself.

03

Not limited to probate cases

Trusts, survivorship ownership and state-specific transfer instruments can move a property without an ordinary probate case. Court-only lists do not identify those paths.

04

Property data with optional contact enrichment

Size, location, value, and tax information come with the property record. Phone, email, spouse, and relative data are available through the skip tracing add-on.

What we mean by pre-probate

Pre-probate > probate. Here's why.

Our Taylor County data is not a court probate list. It identifies inherited-property records from deaths, including properties that may later enter probate and properties that never do.

The court docket is only one transfer path.

A trust, survivorship ownership or an authorized transfer deed may keep a property out of an ordinary probate case. The exact rules vary by state, which is why the local court and transfer details above matter.

An inheritance creates choices, not a guaranteed sale:

  • Keep or occupy the property
  • Rent it or transfer it within the family
  • Sell it privately or through a public listing

FAQ

Taylor County-specific questions.
How many Taylor County probate leads come in each month?
About 54 new pre-probate records in a typical month and 55 on average over the last year. The slowest tracked month produced 31 and the peak hit 81, so the count swings widely.
Why does Taylor County split probate cases between three courts?
Most applications go to the County Court, but a filer can request one of the two statutory County Courts at Law, which divide cases by the decedent's last name initial. All three hold concurrent probate jurisdiction under Texas law.
Does the Texas small estate affidavit transfer a house?
It cannot move a house in general: the affidavit covers personal property up to $75,000, except where a homestead is the estate's only real property and is recorded in the deed records. It is filed with the clerk, so it remains a court record.
Do you have leads for Abilene, Texas?
The county file covers qualifying properties throughout Taylor County, including Abilene. Record counts vary by month and are not guaranteed for one city.
How do I work these leads in Taylor County?
Begin with a simple, respectful letter that identifies the property and explains why you are writing. Use a measured follow-up sequence, honor opt-outs, and follow the marketing rules that apply to your channel. Phone and email enrichment is available as an add-on.
Why purchase from USLeadList?
USLeadList matches death records with property records. Each monthly file is checked against MLS data to remove properties already sold. The same lead is delivered to no more than three USLeadList subscribers. This is limited distribution, not market-wide exclusivity or protection from other data sources.
Who uses USLeadList pre-probate leads?
Real estate investors, wholesalers, flippers, and agents looking for inherited-property opportunities.
