Inside New Castle County

What the data looks like here.

Across 55 tracked months, New Castle County pre-probate and inheritance data has run at 178 records a month on average, 170 in a typical one. The records are built from death and property records, so inherited homes around Wilmington surface without waiting on a probate filing.

Why investors work New Castle County

Delaware repealed its inheritance tax and its estate tax, and a house is not reassessed because it changed hands, so an inheritance here does not hand an heir a new annual bill that forces a quick decision. The decision is about title instead. The Register of Wills states plainly that an estate must be probated when the decedent owned Delaware real estate in his or her name alone, whether solely or as a tenant in common. A recorded transfer on death deed, which under 25 Del. C. ch. 2 governs owners dying on or after December 4, 2025, takes the opposite path: the house passes at death with no filing at the Register at all, and a joint tenancy or a revocable trust does the same. So on the same street, one death produces a court file and the next produces nothing a docket would show.

On the ground

University of Delaware researchers studying Route 9's post-war housing split the corridor at the interstate: seven subdivisions south of Wilmington on one side, five more on the other between the highway and the old city of New Castle. Dunleith, Oakmont and Rosegate were the first, and possibly the only, New Castle County subdivisions where Black families could buy new homes. Delaware's public archives dates Dunleith's land release to 1950 and 1951, the first subdivision in suburban New Castle County built for African American veterans. Find out which side of the split a parcel sits on before treating the corridor as one tier of housing.

Comparing Probate Lead Sources in New Castle County

New Castle County estates go to the Register of Wills, the elected county probate office that the county describes as a branch of the Delaware Chancery Court; routine matters stay there and contested proceedings or appeals move to Chancery. Nothing is e-filed: the office runs on paper and fillable PDF forms, and openings require an appointment. Its Wills Finder publishes the file number, date of death, the decedent's address, and the personal representative or attorney, and since a filed will is public record anyone may copy, competing investors can inspect the same filed case once it exists. That index trails the death it describes: the county puts administration at about a year and pre-death claims are barred eight months out. A recorded transfer on death deed under 25 Del. C. ch. 2, or a joint tenancy or trust, moves a house with nothing filed at the Register, so no docket shows it. USLeadList instead works from death and property records about five weeks after a death, without waiting for a probate filing and independent of whether one is ever opened, and a case that opens sooner does not change what the file already holds.

How Delaware rules shape New Castle leads

Verified state research, applied locally.

Delaware has no inheritance tax and no estate tax. Title 30, Chapter 13 is captioned Inheritance [Repealed], and Chapter 15, the estate tax, was repealed by 81 Del. Laws, c. 52, effective January 1, 2018. Delaware also does not reassess property because it changed hands, so nothing about inheriting a house creates a recurring cost of holding it. What Delaware does is make probate avoidable. The Uniform Real Property Transfer on Death Act, 25 Del. C. ch. 2, applies to transferors dying on or after December 4, 2025, and a recorded transfer on death deed passes the house with no filing at the Register of Wills. Joint tenancy with right of survivorship and revocable trusts do the same. The affidavit at 12 Del. C. 2306 does not reach houses at all: it is unavailable if the decedent owned Delaware real estate solely or as a tenant in common.

01

Ways property can avoid probate

Transfer on death deed under the Uniform Real Property Transfer on Death Act, 25 Del. C. ch. 2, enacted by 85 Del. Laws, c. 212 and applying to transferors dying on or after December 4, 2025. Joint tenancy with right of survivorship and revocable living trusts are the older routes. The 12 Del. C. 2306 affidavit covers personal property only and is barred outright where the decedent owned Delaware real estate.

02

Small-estate route

Distribution without a grant of letters where the personal estate, excluding jointly owned property and property described in 12 Del. C. 1901(b) and (c), does not exceed $50,000, 30 days have elapsed since death, and the decedent owned no Delaware real estate solely or as a tenant in common (12 Del. C. 2306). The $50,000 figure took effect June 10, 2026 under 85 Del. Laws, c. 281, raising the prior $30,000 limit.

03

Timing that affects the public record

A custodian of a will must deliver it to the Register of Wills within 10 days of learning of the death (12 Del. C. 1301(a)). Claims that arose before or at death are barred unless presented within 8 months of the decedent's death (12 Del. C. 2102(a)); post-death claims run 6 months. Notice to creditors must be published in an approved newspaper at least 3 times, once a week for 3 successive weeks, within 40 days of the grant of letters (12 Del. C. 2101). A small estate affidavit under 12 Del. C. 2306 may not be used until 30 days after death. The New Castle County Register of Wills states that administering an estate takes approximately one year.

04

Where court cases can be checked

No statewide search reaches estates. CourtConnect covers civil dockets of the Superior Court, the Court of Common Pleas and the Justice of the Peace Court only. Estate records are searched at each county Register of Wills: New Castle County offers a will search and an affidavit search, Kent County offers an estate search, and Sussex County posts Register's Orders and accepts written estate search requests for a fee.

A court-file list covers only estates that reach a public probate case. USLeadList starts with death and property matching instead of waiting for that filing.

Why pre-probate

Why pre-probate leads in New Castle County, Delaware?

A public probate list requires a filed case. Our source does not require a filing and may precede a later filing, but that is not guaranteed.

01

Inheritance creates a property decision

A death does not guarantee a sale. It does create practical decisions about upkeep, distance, taxes, repairs and whether anyone in the family wants the property.

02

Earlier than a court filing

When probate is required, the public case begins after the death and after someone files. Our county records begin with the death record itself.

03

Not limited to probate cases

Trusts, survivorship ownership and state-specific transfer instruments can move a property without an ordinary probate case. Court-only lists do not identify those paths.

04

Property data with optional contact enrichment

Size, location, value, and tax information come with the property record. Phone, email, spouse, and relative data are available through the skip tracing add-on.

What we mean by pre-probate

Pre-probate > probate. Here's why.

Our New Castle County data is not a court probate list. It identifies inherited-property records from deaths, including properties that may later enter probate and properties that never do.

The court docket is only one transfer path.

A trust, survivorship ownership or an authorized transfer deed may keep a property out of an ordinary probate case. The exact rules vary by state, which is why the local court and transfer details above matter.

An inheritance creates choices, not a guaranteed sale:

  • Keep or occupy the property
  • Rent it or transfer it within the family
  • Sell it privately or through a public listing

FAQ

New Castle County-specific questions.
How many pre-probate records does New Castle County produce in a month?
