Inside McLennan County

What the data looks like here.

Over the last 12 months, McLennan County's pre-probate and inheritance data averaged about 85 new records a month, and the busiest month since March 2022 reached 112. It is built from death and property records, so it does not wait on a probate filing.

Why investors work McLennan County

Texas has no estate tax and no inheritance tax, so an heir inherits a property tax bill that depends on who moves in. A non-occupying heir loses the residence homestead exemption, including the $140,000 of appraised value shielded from school district tax, and the 10 percent appraisal cap ends on January 1 of the first year neither the prior owner nor a surviving spouse qualifies. The school tax ceiling an owner 65 or older held passes only to a surviving spouse 55 or older who keeps the home, never to a child. For a daughter in Houston who now owns her mother's Waco house, that turns a sentimental asset into a cost decision: occupy it, rent it, or sell it. Texas also lets an owner record a transfer on death deed before death, which moves title without an ordinary probate case.

On the ground

Waco ran the largest urban renewal program in Texas, and that record explains why McLennan's older housing is not one continuous district. The city completed ten renewal projects by the late 1970s and bought and renewed more than 2,100 acres. Sandtown, a Mexican American neighborhood between Third Street and the river, was cleared and its residents scattered across the city and county, while Edgefield, built around the 1919 Miller Cotton Mill on the south side, lost 197 acres to Baylor's expansion. For an inherited Waco address, the useful question is which development era it belongs to and which side of the Brazos it sits on, because the county's housing did not arrive in one wave.

Comparing Probate Lead Sources in McLennan County

McLennan County has no statutory probate court, so original probate jurisdiction sits with the County Court of McLennan County, where the County Judge hears the probate docket; applications go to the County Clerk, and attorneys file through eFileTexas. The clerk's probate index is public from 1961 forward, and any investor who registers can pull the same filed estate, so a case on that index is shared ground. Texas offers a small estate affidavit 30 days after an intestate death, but it cannot move real property except in a narrow homestead case. A transfer on death deed recorded in the deed records before the owner died is the route that genuinely bypasses an ordinary probate case. USLeadList builds the file from death and property records, typically about five weeks after a death, without waiting for a probate filing and whether or not one is ever opened, and no lead goes to more than three subscribers. That is the buying case: the docket covers an estate someone already opened, while the county file reaches the property first.

How Texas rules shape McLennan leads

Verified state research, applied locally.

Texas has no estate tax and no inheritance tax, the inheritance tax having been repealed effective September 1, 2015. The 10 percent appraisal cap expires on January 1 of the first tax year in which neither the owner when the limitation took effect nor that owner's spouse or surviving spouse qualifies for a Section 11.13 exemption (Tax Code 23.23(c)), and the exemptions lost are substantial, including $140,000 of appraised value exempt from school district tax under Tax Code 11.13(b). The school tax ceiling an owner aged 65 or older held under Tax Code 11.26 passes only to a surviving spouse aged 55 or older who keeps the home, never to a child. An heir property owner who occupies the house is considered the sole recipient of any exemption granted for that residence homestead (Tax Code 11.13(h)) and the sole owner for qualification (Tax Code 11.41(c)), and can apply without clear title, on a death certificate and a utility bill, because the application form may not require an heir property owner to produce a recorded instrument (Tax Code 11.43(o) and (o-1)). The squeeze lands on non occupying heirs, who lose the exemptions and the cap and pay on a full market appraisal.

01

Ways property can avoid probate

Transfer on death deed under Estates Code Chapter 114, in force since September 1, 2015 and effective only if recorded in the county deed records before the transferor's death. Also the Lady Bird or enhanced life estate deed, probate of a will as a muniment of title under Estates Code 257.001 where the estate owes no unpaid debt other than a lien on real estate, and the Estates Code 205.001 small estate affidavit.

02

Small-estate route

Small estate affidavit under Estates Code 205.001, available only where the decedent died intestate, 30 days have elapsed since death, no petition to appoint a personal representative is pending or has been granted, and estate assets excluding homestead and exempt property do not exceed $75,000, a figure set by 2017 House Bill 2271 effective September 1, 2017. Estates Code 205.008(b) keeps the affidavit from transferring real property, with one exception: under 205.006 it may pass title to the homestead where the homestead is the only real property in the estate and the affidavit is recorded in the deed records.

03

Timing that affects the public record

Statutory floor: within one month after receiving letters the personal representative must publish notice to creditors in a newspaper of general circulation in the county where the letters were issued (Estates Code 308.051), and within two months must give notice to each known secured creditor (308.053). Texas imposes no general creditor claim period; a 121 day bar applies only to an unsecured creditor the representative chooses to notify under 308.054, so an independent administration is not held open by a statewide claim window. A will may not be admitted to probate after the fourth anniversary of the testator's death unless the applicant shows they were not in default (256.003). The small estate affidavit is usable 30 days after death (205.001). No Texas judiciary source publishes a typical duration.

04

Where court cases can be checked

No free statewide trial court search. re:SearchTX is the statewide index of e-filed trial court records and sits behind a sign in. The Case Search at search.txcourts.gov is the appellate TAMES system covering the Supreme Court, the Court of Criminal Appeals and the courts of appeals, and it holds no trial court cases. Failing those, the county clerk's own online records.

A court-file list covers only estates that reach a public probate case. USLeadList starts with death and property matching instead of waiting for that filing.

Why pre-probate

Why pre-probate leads in McLennan County, Texas?

A public probate list requires a filed case. Our source does not require a filing and may precede a later filing, but that is not guaranteed.

01

Inheritance creates a property decision

A death does not guarantee a sale. It does create practical decisions about upkeep, distance, taxes, repairs and whether anyone in the family wants the property.

02

Earlier than a court filing

When probate is required, the public case begins after the death and after someone files. Our county records begin with the death record itself.

03

Not limited to probate cases

Trusts, survivorship ownership and state-specific transfer instruments can move a property without an ordinary probate case. Court-only lists do not identify those paths.

04

Property data with optional contact enrichment

Size, location, value, and tax information come with the property record. Phone, email, spouse, and relative data are available through the skip tracing add-on.

What we mean by pre-probate

Pre-probate > probate. Here's why.

Our McLennan County data is not a court probate list. It identifies inherited-property records from deaths, including properties that may later enter probate and properties that never do.

The court docket is only one transfer path.

A trust, survivorship ownership or an authorized transfer deed may keep a property out of an ordinary probate case. The exact rules vary by state, which is why the local court and transfer details above matter.

An inheritance creates choices, not a guaranteed sale:

  • Keep or occupy the property
  • Rent it or transfer it within the family
  • Sell it privately or through a public listing
