Inside Oneida County

What the data looks like here.

Utica and Rome sit inside one county line but not one market, and the pre-probate and inheritance data we keep on Oneida County reflects that: roughly 84 records in a typical month, 88 averaged across the past year. Each lead goes to no more than three subscribers.

Why investors work Oneida County

Oneida's housing stock was set first by textile mills and then by Griffiss Air Force Base, which opened in 1950 and closed in 1995, and the county's 2025 housing study still names aging housing stock among its central problems. Inheritance here rarely arrives with a clock attached. The cost that does change is on the tax bill: STAR and Enhanced STAR belong to the owner who registered for them, so when a house passes to an heir the school tax rises until that heir registers and qualifies alone. Nothing in that forces a sale, and it should not be read as one. A transfer on death deed recorded under Real Property Law 424 is the other piece, because it can move a property without an ordinary probate case, so not every inherited house will surface in court.

On the ground

Utica divides on a line outsiders rarely notice. The first steam mills went up in West Utica in the 1840s and pulled German and Irish workers into the blocks beside them, while the mills built after 1860 went east along Broad Street and drew Italian settlement to the Bleecker and Mohawk intersection. Polish mill families settled in West Utica and in the village fabric of Whitesboro, Yorkville and New York Mills, so those villages deserve their own search rather than a Utica sweep. The county's own 2025 housing study splits the market into Utica, Rome and separate North, West and South submarkets, worth remembering before pricing a Rome three-bedroom against a New Hartford one.

Comparing Probate Lead Sources in Oneida County

Oneida County has a single Surrogate's Court, and its own e-filing protocol makes NYSCEF mandatory for proceedings commenced there on or after July 17, 2017. New York sets no waiting period before an estate petition can be filed, and SCPA 1802 shields a fiduciary from claims raised more than seven months after letters first issue, which is the clock that actually paces distribution. Filed cases become public records, and WebSurrogate, the Unified Court System's free estate search, lets any other investor pull the same names. Article 13 voluntary administration handles personal property of $50,000 or less, and SCPA 1302 keeps real property out of it, so it explains nothing about how a house changes hands; the transfer on death deed is the instrument that does. USLeadList builds the Oneida County file from death and property records, typically about five weeks after a death. It does not wait on a probate filing, often arrives before one, and is not limited to properties that ever reach Surrogate's Court.

How New York rules shape Oneida leads

Verified state research, applied locally.

New York puts no recurring pressure on an heir to sell. The class 1 assessment caps in New York City and Nassau County limit annual and five year increases parcel by parcel and carry no change of ownership reset (RPTL 1805), so a tax bill does not jump because title moved, and the state has no acquisition value system. The estate tax reaches almost no one: the basic exclusion amount is $7,350,000 for 2026 deaths and $7,160,000 for 2025 deaths, and Tax Law 952 withdraws the credit entirely once the New York taxable estate exceeds 105 percent of that amount. There is no inheritance tax. The real loss to an heir is the decedent's STAR, Enhanced STAR and senior exemptions, which do not pass with the house and raise the school tax bill until the heir qualifies alone. What keeps New York houses out of Surrogate's Court is the transfer on death deed at Real Property Law 424, in effect since July 19, 2024, which needs two witnesses present at the same time, a notary, and recording in the county clerk's office before the transferor's death.

01

Ways property can avoid probate

Transfer on death deed under Real Property Law 424, in effect since July 19, 2024, requiring two witnesses present at the same time, acknowledgment before a notary, and recording before the transferor's death. Also revocable living trusts, joint ownership with right of survivorship, and SCPA Article 13 voluntary administration for personal property up to $50,000.

02

Small-estate route

SCPA Article 13, Settlement of Small Estates Without Court Administration, handled by a voluntary administrator. A small estate is one leaving personal property with a gross value of $50,000 or less, exclusive of property required to be set off under EPTL 5-3.1(a) (SCPA 1301, raised from $30,000 by L. 2019, ch. 557, effective November 25, 2019). SCPA 1302 keeps New York real property out of the procedure, but the decedent's ownership of real property does not prevent the estate from using Article 13 for the personal property.

03

Timing that affects the public record

Statutory floor: there is no waiting period before a probate or administration petition may be filed. Under SCPA 1802 a fiduciary who has paid lawful claims, legacies or distributions in good faith is not chargeable for a claim presented later than 7 months from the date letters were first issued, so that 7 month window, running from issuance of letters rather than from death, is the practical floor before an estate is distributed. SCPA 1802 protects the fiduciary rather than extinguishing a late claim. No Unified Court System source publishes a typical duration.

04

Where court cases can be checked

WebSurrogate, the free Unified Court System search of estate proceedings and other filings in New York State Surrogate's Courts. It links document images only for filings made on or after February 19, 2014 and suppresses restricted files such as guardianship and adoption. NYSCEF's Search as Guest covers e-filed matters.

A court-file list covers only estates that reach a public probate case. USLeadList starts with death and property matching instead of waiting for that filing.

Why pre-probate

Why pre-probate leads in Oneida County, New York?

A public probate list requires a filed case. Our source does not require a filing and may precede a later filing, but that is not guaranteed.

01

Inheritance creates a property decision

A death does not guarantee a sale. It does create practical decisions about upkeep, distance, taxes, repairs and whether anyone in the family wants the property.

02

Earlier than a court filing

When probate is required, the public case begins after the death and after someone files. Our county records begin with the death record itself.

03

Not limited to probate cases

Trusts, survivorship ownership and state-specific transfer instruments can move a property without an ordinary probate case. Court-only lists do not identify those paths.

04

Property data with optional contact enrichment

Size, location, value, and tax information come with the property record. Phone, email, spouse, and relative data are available through the skip tracing add-on.

What we mean by pre-probate

Pre-probate > probate. Here's why.

Our Oneida County data is not a court probate list. It identifies inherited-property records from deaths, including properties that may later enter probate and properties that never do.

The court docket is only one transfer path.

A trust, survivorship ownership or an authorized transfer deed may keep a property out of an ordinary probate case. The exact rules vary by state, which is why the local court and transfer details above matter.

An inheritance creates choices, not a guaranteed sale:

  • Keep or occupy the property
  • Rent it or transfer it within the family
  • Sell it privately or through a public listing

FAQ

Oneida County-specific questions.
How many Oneida County leads arrive in a typical month?
About 84 new pre-probate records in a typical month, with 88 as the twelve-month average and 1,051 records across that span. The slowest tracked month produced 44 and the busiest 121.
Does Oneida County have its own probate court, or several?
New York keeps one Surrogate's Court in each county, so an estate here files in the same court whether the house sits in Utica or out in Boonville or Camden. Its own NYSCEF protocol has required e-filing for new proceedings since July 17, 2017.
Can an Oneida County house pass without reaching Surrogate's Court?
Yes, if the owner recorded a transfer on death deed under Real Property Law 424 before dying: two witnesses, a notary, and recording with the county clerk. The statute transfers the property at the owner's death without probate.
Do you have leads for Utica, New York?
The county file covers qualifying properties throughout Oneida County, including Utica. Record counts vary by month and are not guaranteed for one city.
How do I work these leads in Oneida County?
Begin with a simple, respectful letter that identifies the property and explains why you are writing. Use a measured follow-up sequence, honor opt-outs, and follow the marketing rules that apply to your channel. Phone and email enrichment is available as an add-on.
Why purchase from USLeadList?
USLeadList matches death records with property records. Each monthly file is checked against MLS data to remove properties already sold. The same lead is delivered to no more than three USLeadList subscribers. This is limited distribution, not market-wide exclusivity or protection from other data sources.
Who uses USLeadList pre-probate leads?
Real estate investors, wholesalers, flippers, and agents looking for inherited-property opportunities.
