Small-estate route

Affidavit for collection of personal property where the value of all personal property in the estate, wherever located, less liens and encumbrances, does not exceed $200,000, usable 30 days after death (A.R.S. 14-3971(B)). Affidavit of succession to real property where the value of Arizona real property, less liens and encumbrances, does not exceed $300,000, usable 6 months after death, with the interest valued from the full cash value shown on the assessment rolls for the year in which the decedent died (A.R.S. 14-3971(E)). Both ceilings were raised from $75,000 and $100,000 by Laws 2025, chapter 24 (HB 2116), which took the general effective date of September 26, 2025. A separate affidavit collects up to $5,000 of wages owed by an employer with no waiting period.

Timing that affects the public record

The personal representative publishes notice to creditors once a week for three successive weeks in a newspaper of general circulation in the county, and creditors must present claims within 4 months after the date of first publication or be forever barred (A.R.S. 14-3801). A.R.S. 14-3803 bars a claim not presented within the earlier of the 14-3801 period or two years after the decedent's death plus the time remaining in a period commenced by actual or published notice. Nothing may be collected by small estate affidavit until 30 days after death for personal property or 6 months after death for real property (A.R.S. 14-3971). No Arizona court publishes a typical duration.
