Probate rules matter because they determine when a public court record appears and which inherited properties never appear in an ordinary probate case.

What changes for an heir

Wyoming attaches a recurring cost to inheriting a house and living elsewhere. W.S. 39-11-105(a)(xliii) and (xliv) exempt any assessed value of a single family residential structure and its associated improved land above the prior year value plus four percent, but the exemption does not apply and the property is valued at full value if the owner acquired it during the prior calendar year. The listed exceptions cover spouses, court orders and transfers to a trust or entity for the prior owner, not an inheritance by a child, and a fifth lets the Department of Revenue exempt further transfers by rule, which its Chapter 14 rules effective August 26, 2026 do not do. Separately, beginning with tax year 2026 the 25 percent homeowner exemption on the first $1,000,000 of fair market value applies only where the claimant actually resides at least eight months of the year (W.S. 39-11-105(a)(xlvi)). Wyoming has no inheritance tax and its estate tax tracks the eliminated federal state death tax credit (W.S. 39-19-103).

Where probate records appear

District Court None. The Wyoming Judicial Branch states that it does not currently offer remote public access to filings in the circuit or district courts, and that anyone who is not an attorney of record on a case cannot reach that case's filings through File and ServeXpress. District court filings are viewable free at designated public access terminals in courthouses across the state and at the Wyoming State Law Library, or through the county clerk of district court. Only chancery court filings are available online, to registered users for a fee.

Ways property can avoid ordinary probate

Transfer on death deed under the Nontestamentary Transfer of Real Property on Death Act, W.S. 2-18-101 and following, recorded before the owner's death; joint tenancy with right of survivorship; revocable living trust; and the W.S. 2-1-201 affidavit or W.S. 2-1-205 summary distribution decree for estates up to $400,000.

Small-estate route

Two routes, both capped at $400,000 since July 1, 2025, when 2025 Wyoming Session Laws ch. 168 (SF0104) raised each from $200,000. W.S. 2-1-201 lets a distributee collect personal property by an affidavit filed with the county clerk not earlier than 30 days after death, where the entire Wyoming estate subject to administration, less liens and encumbrances, does not exceed $400,000 and no personal representative has been appointed in the state. W.S. 2-1-205 covers real property, including mineral interests, on the same $400,000 ceiling: the distributee applies for a decree of summary distribution not earlier than 30 days after death, attaching a sworn report of value.

Timing investors should understand

For a full probate the floor is the creditor window. W.S. 2-7-201 requires the personal representative to publish notice once a week for three consecutive weeks, and W.S. 2-7-703 bars forever any claim not filed within three months of first publication or within 30 days after the mailed notice, whichever is later. A creditor may apply for letters within two years of death, and if none issue in that time all creditor claims are barred (W.S. 2-4-211, 2-4-212). For summary distribution the 30 days in W.S. 2-1-205(a) is a minimum wait before the application may be filed, not a duration: after filing, notice is published once a week for two consecutive weeks and mailed, objections are due the later of 20 days after mailing or 30 days after first publication, and only then may the court enter the decree, which is recorded with the county clerk. Wyoming publishes no official typical duration.
